The property owned by Robert Sis is about 20 acres,zoned industrial and encompasses property on both the north and south side of CSAH 75.The existing billboards were installed on the property a number of years ago.The new signs would be monopole style with upgraded LED lighting. Stearns County Land Use and Zoning Ordinance 439 governs St.Joseph Township and requires a conditional use permit for billboard replacements. SITE INFORMATION Location: PID#31.20808.0000 Zoning: Industrial District Department/Agency Comments: The submitted land use request has been forwarded to the Township Building Inspector and Stearns County for review and comment. Wetlands:There are wetlands on the property. Stearns County administers the Wetland Conservation Act (WCA)and has reviewed the application.The proposed impact is approximately 20 square feet for each monopole.The actual billboards will impact less than the de minimis exemption amount.Caution is needed that the wetland isn't permanently impacted to get heavy equipment on site to install the billboards.Pads must be used traverse over the wetland from CR 75 to the billboard sites. Access: Stearns County is the road authority.Any access requests and permits would need to be approved and secured from Stearns County. Size and Height: The current ordinance allows a surface area of up to 600 SF and 30 feet high. Since the billboards were installed pre-ordinance,they are considered legal non-conformities when they don't meet zoning requirements.The signs are allowed to continue,including through replacement but may not be enlarged. We will not be replacing the sign at monumental sales at this time, maybe in the future. The heights and size of the existing signs are: North side of road, 26 'tall and size 400 sq ft. On the south side of the road the stacked sign is 36'feet tall and the size is 600 sq ft. The new sign on the north side will be 28 'tall and 388 sq ft. per side. The new sign on the south side will be 36'tall and 600 sq ft per side. The existing lighting on the north side is 4-400 watt metal halide bulbs in Panel view fixtures. The existing lighting on the south side is 4—250 watt metal halide bulbs in Panel view fixtures. Any new lights will be LED lights and fixtures made for the billboard industry and will be attached directly to the sign structure. Let me know if you need further information. "Subject Property" The St.Joseph Joint Planning Board acknowledged the following Findings of Fact in consideration of the request for a Conditional Use Permit for two billboard signs on the Subject Property: 1. The matter was duly published and notice was provided to property owners within 1320 feet (.25 mile)of the above referenced property and the Joint Planning Board conducted a public hearing on January 8,2019. 2. The Subject Property is in St.Joseph Township within the orderly annexation area of the City of St. Joseph and zoned industrial. 3. The adjacent properties are zoned industrial to the north, east and west, and urban expansion to the south. 4. The current adjacent land uses to the Subject Property are open space, and commercial to the east. 5. Stearns County Land Use and Zoning Ordinance 439 governs St. Joseph Township Orderly Annexation Area and requires a conditional use permit for billboard replacement. 6. The two existing billboard signs were installed pre-ordinance.The purpose of the conditional use permit request is for the replacement of the two existing billboards signs to be monopole style with LED lighting on the Subject Property. 7. DECISION Based on the Findings of Fact,the St.Joseph Joint Planning Board approves a Conditional Use Permit(CUP)for the replacement of two billboard signs on the Subject Property with the following conditions: 1. The applicant/property owner is responsible for meeting all Federal, State, and Local requirements,including but not limited to meeting the Stearns County Land Use and Zoning Ordinance,and the MN State Building Code and obtaining any and all permits and licenses. 2. Building permits must be obtained prior to the installation of the billboard signs. 3. Access shall be approved by Stearns County as the road authority and any required access permits shall be obtained from Stearns County. 4. The wetland shall not be permanently impacted.Pads must be used traverse over the wetland from CSAR 75 to the billboard sites. Caution shall be used that the heavy equipment used to install the billboards will not permanently impact the wetland. 5. The two billboard signs shall be located in the same location as the existing signs on the Subject Property. 6. Lighting shall be hooded or controlled and directed so as to not light adjacent properties and roadways. 7. Signage shall meet the requirements of Stearns County Ordinance 439. 8. Revocation: The Joint Planning Board shall revoke the conditional use permit if it determines that the terms and conditions of the permit as issued are no longer being complied with.A certified copy of an order of the Joint Planning Board revoking the interim use permit shall be filed with the County Recorder for recording. 9. Expiration: If within one(1)year after issuance of granting a conditional use permit the use permitted has not started,then the permit is null and void,unless the Joint Planning Board has approved a petition for an extension. The conditional use permit shall expire if the authorized use ceases for any reason for more than one(1)year. 10. The St.Joseph City Administrator and/or his/her designee shall have the right to inspect the Subject Property for compliance and safety purposes annually or at any time upon reasonable request.
