PREVIOUS COUNCIL ACTION: The Council authorized the Engineer to prepare the feasibility report for
the proposed 2019 Street Improvements and authorized the public improvement hearing.
BACKGROUND INFORMATION: The construction of local improvements is regulated through the 429
process which includes a series of resolutions that must be adopted by the Council. The City Council has
already completed the first resolution by ordering the feasibility report. The second step is to review
and accept the feasibility report and if ready adopt a resolution ordering the hearing for the public
improvement, providing residents with notice of the proposed improvement and projected assessment.
The purpose of this hearing is not to focus on the assessment; rather the merits of the project. At this
time the project is not designed and the numbers are merely an estimate. Residents will have an
opportunity at a later time to discuss the assessments when final numbers are available.
The third step in the process is to order the improvement. Since the project has many components the
Council needs to determine which projects move to the next step which is construction documents and
bidding. If the Council needs additional time for consideration the matter could be tabled. Ordering a
public improvement does required a super majority vote. That is, 4 of 5 must vote in favor. If a council
member is absent all four would need to vote in favor. An absence of a councilor does not reduce the
number of votes required.

WHEREAS, a resolution of the city council adopted on the 16th day of January, 2019, fixed a date for a

Baker Street and a point 250 feet south of Dale Street, Pond View Lane E between E Baker Street and

reconstructing the bituminous street, and to assess the benefited property for a portion of the cost of the
improvement.
AND WHEREAS, ten days’ mailed notice and two weeks’ published notice of the hearing was given, and

the hearing was held thereon on the 4 day of February, 2019, at which all persons desiring to be heard
were given an opportunity to be heard thereon,
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF ST. JOSEPH, MINNESOTA:
1. Such improvement is necessary, cost-effective, and feasible as detailed in the feasibility report.

2. Such improvement is hereby ordered as proposed in the council resolution adopted the 4 day of
February, 2019.
3. SEH is here by designated as the engineer for this improvement. The engineer shall prepare plans
and specifications for the making of such improvement.
4. The city council declares its official intent to reimburse itself for the costs of the improvement
from the proceeds of the tax exempt bond.

Notice is hereby given that the City Council of the City of St.Joseph will in in the Government

Avenue SE cul-de-sac south of E Baker Street,E Baker Street between a point 250 feet west of
Mayor 12th Avenue SE and 16th Avenue SE, Callaway Street E between 12th Avenue SE and Pond

Bob Loso improvements of Old Highway 52 between Birch Street W and CSAH 75 and,the complete
Brian Theisen loop of Cypress Drive south west of Old Highway 52 by reconstructing the sanitary sewer and
bituminous streets; and the improvements of Elm Street W between 1St Avenue NW and College
Avenue N and Elm Street E between College Avenue N and 1st Avenue NE by constructing new
water main and sanitary sewer and reconstructing the bituminous street.
The estimated cost of the improvement is $2,175,000. Such persons as wishing to be heard
with reference to the proposed improvement will be heard at this meeting.
