HomeMy WebLinkAbout[07] 2019 Proposed Public Improvement Hearing Council Agenda Item 7 MEETING DATE: February 4, 2019 AGENDA ITEM: Public Hearing – 2019 Proposed Street Improvement SUBMITTED BY: Engineering/Administration BOARD/COMMISSION/COMMITTEE RECOMMENDATION: PREVIOUS COUNCIL ACTION: The Council authorized the Engineer to prepare the feasibility report for the proposed 2019 Street Improvements and authorized the public improvement hearing. BACKGROUND INFORMATION: The construction of local improvements is regulated through the 429 process which includes a series of resolutions that must be adopted by the Council. The City Council has already completed the first resolution by ordering the feasibility report. The second step is to review and accept the feasibility report and if ready adopt a resolution ordering the hearing for the public improvement, providing residents with notice of the proposed improvement and projected assessment. The purpose of this hearing is not to focus on the assessment; rather the merits of the project. At this time the project is not designed and the numbers are merely an estimate. Residents will have an opportunity at a later time to discuss the assessments when final numbers are available. The third step in the process is to order the improvement. Since the project has many components the Council needs to determine which projects move to the next step which is construction documents and bidding. If the Council needs additional time for consideration the matter could be tabled. Ordering a public improvement does required a super majority vote. That is, 4 of 5 must vote in favor. If a council member is absent all four would need to vote in favor. An absence of a councilor does not reduce the number of votes required. ATTACHMENTS: Request for Council Action Feasibility Report Proposed Resolution 2019-005 Ordering Improvement and Preparation of plans REQUESTED COUNCIL ACTION: Provide direction RESOLUTION 2019-005 ORDERING IMPROVEMENT AND PREPARATION OF PLANS 2019 Street Improvement Project WHEREAS, a resolution of the city council adopted on the 16th day of January, 2019, fixed a date for a th council hearing on the proposed improvement to 12 Avenue SE between a point 250 feet north of E Baker Street and a point 250 feet south of Dale Street, Pond View Lane E between E Baker Street and th Dale Street, 13 Avenue SE cul-de-sac south of E Baker Street, E Baker Street between a point 250 feet ththth west of 12 Avenue SE and 16 Avenue SE, Callaway Street E between 12 Avenue SE and Pond View th Lane E, Cary Court cul-de-sac east of 12 Avenue SE, Cedar Court cul-de-sac east of Pond View Lane E, ththth Dale Street E between a point 250 feet west of 12 Avenue SE and 16 Avenue SE, 4 Avenue NE th between County State Aid Highway (CSAH) 75 and Minnesota Street E, 4 Avenue SE between st Minnesota Street E and E Baker Street, 1 Avenue NW between CSAH 75 and Minnesota Street W, ndnd Birch Street W between 2 Avenue NW and College Avenue N, Ash Street W between 2 Avenue NW and College Avenue N and, Jade Road between County Road 121 and the south City limits at Interstate 94 by resurfacing the bituminous streets by overlay, mill and pave, or reclaim and pave methods; and the improvements of Old Highway 52 between Birch Street W and CSAH 75 and, the complete loop of Cypress Drive south west of Old Highway 52 by reconstructing the sanitary sewer and bituminous streets; st and the improvements of Elm Street W between 1 Avenue NW and College Avenue N and Elm Street E st between College Avenue N and 1Avenue NE by constructing new water main and sanitary sewer and reconstructing the bituminous street, and to assess the benefited property for a portion of the cost of the improvement. AND WHEREAS, ten days’ mailed notice and two weeks’ published notice of the hearing was given, and th the hearing was held thereon on the 4 day of February, 2019, at which all persons desiring to be heard were given an opportunity to be heard thereon, NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF ST. JOSEPH, MINNESOTA: 1. Such improvement is necessary, cost-effective, and feasible as detailed in the feasibility report. th 2. Such improvement is hereby ordered as proposed in the council resolution adopted the 4 day of February, 2019. 3. SEH is here by designated as the engineer for this improvement. The engineer shall prepare plans and specifications for the making of such improvement. 4. The estimated cost of the improvement is $2,175,000. Such persons as wishing to be heard with reference to the proposed improvement will be heard at this meeting.
