STAFF RECOMMENDATION:Adopt the Findings of Facts RecommendingApprovalto Zone
Annexation Area as presented.
PREVIOUS PLANNING COMMISSION ACTION:On August 22, 2018 the Planning Commission
approved the RR-Rural Residential District Ordinance.
BACKGROUND INFORMATION: TheCity of St. Joseph and St. Joseph Township entered into an
Orderly Annexation Agreement in 1996 and amended thereafter. The annexation of a portion of St.
Joseph Township was completed in January 2019. There are properties that will remain in St. Joseph
Township but are still within the City’sOrderly Annexation Area (OAA) and the St. Joseph Joint
Planning Board will continue to govern land use mattersin the OAA. The City and Township created a
new RR –Rural Residential District Ordinance to preserve a rural lifestyle. This Ordinance includes Rural
Quality of Life Provisionswhich exempts property owners from certain regulations in the urban/city area.
Those items include:
Animals: flexibility in the license and regulation of animals;
Hunting/Firearms: allowance to continue with a permit provided property owners follow State
and Federal laws and monitoring by the Police Chief as properties develop
Burning: Burning is allowed; however must be approved and permitted by DNR
Rental License: no restriction on renting dwelling or portion thereofprovided a City license is
secured
Wood Burning Stoves –allowed
Noise –exempt from City Ordinance 1002 provided it does not become a public nuisance or
endangerment to others.
The proposed zoning for the recently annexed area is RR-Rural Residentialfor properties previously
zoned Urban Expansion, and Residential R-5,B-2 Highway Business for properties previously zoned
Commercial and LI-Light Industrial for properties previously zoned Industrial.

RESOLUTION ADOPTING FINDINGS OF FACTAND RECOMMENDING APPROVAL OF
THE ZONING OF CERTAIN PROPERTIES TO RR-RURAL RESDENTIAL, B2 HIGHWAY
BUSINESS AND LILIGHT INDUSTRIALDISTRICTS
On February 11, 2019the St. Joseph Planning Commission conducted a public hearing and that said
public hearing was properly advertised at which all persons interested were given the opportunity to be
heardto consider the zoningof certain properties.
WHEREAS,the City of St. Josephinitiated the zoning on certain properties annexedinto the City of St.
Joseph described as follows:
Sections 1, 2, 3, 4,9, 10, 11, 12, 14, 15, 16,22, Township 124, Range 029, St. Joseph, Minnesota.
“Subject Property”
NOW THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY
OF ST. JOSEPH, STEARNS COUNTY, STATE OF MINNESOTA, finds the following facts:
1. Thatthe City of St. Joseph and St. Joseph Township entered into an Orderly Annexation Agreement in
1996and amended thereafter.
2.That the City of St. Joseph and St. Joseph Township created the RR –Rural Residential District to
establish and preserve areas within the City of St. Joseph for the continuation of agricultural operations,
open space and provide for very low density residential development and a rural life-style.
3.That the recently annexed properties were previously zoned Urban Expansion (UE), Residential
District R-5,Commercial and Industrial.
4. That the Orderly Annexation Agreement established that upon annexation properties previously zoned
Urban Expansion and Residential R-5 would be zoned RR-Rural Residential, Commercial would be
zoned B-2 Highway Business District and Industrial would be zoned LI-Light Industrial.
5.That the proposed zoning for the recently annexed area is RR-Rural Residential for properties
previously zoned Urban Expansion, and Residential R-5, B-2 Highway Business for properties previously
zoned Commercial,and LI-Light Industrial for properties previously zoned Industrial.
6.That the proposedzoningdesignations on the Subject Property areconsistent with the City’s Future
Land Use Plan of the Comprehensive Plan.
7. That the proposedzoningdesignations are consistent with the current land uses.
BE IT FURTHER RESOLVED: That based on foregoing Findings of Fact, the Planning Commission
of the City of St Joseph hereby recommends approval of the zoning designationsofthe Subject Property
in accordance with Exhibit A.
Whereupon said resolution was declared duly passed and adopted by the St. Joseph Planning Commission
