BACKGROUND INFORMATION: The construction of local improvements is regulated through the 429 process which includes a series of resolutions that must be adopted by the Council. The purpose of the public improvement hearing is to provide residents with notice of the proposed improvement and projected assessments. The purpose of the hearing is not to focus on the assessment; rather the merits of the project. Those affected will have an opportunity at a later hearing to discuss the assessments when final numbers are available. Anne Buckvold Troy Goracke Judy Weyrens Bob Loso City Administrator Brian Theisen Publish: February 28, 2019 March 14,2019 75 Callaway Street East• Saint Joseph,Minnesota 56374 Email cityoffices@cityofstjoseph.com Phone 320.363.7201 Fax 320.363.0342 RESOLUTION 2019-022 ORDERING IMPROVEMENT AND PREPARATION OF PLANS 2019 Industrial Park Improvements WHEREAS, a resolution of the city council adopted on the 4th day of March, 2019, fixed a date for a council hearing on the proposed improvement to County Road 133 between 19th Avenue NE and a point along CR 133 approximately 1,900 LF northeast of the intersection of 19th Avenue NE and County Road 13 by constructing water main and street improvements; and the improvement of portions of parcel 84.53794.0038 and undeveloped parcels 84.53350.0030, 84.53340.0027, 84.53340.0150, 84.53340.0132, 84.53350.0027, 84.53340.0130, 84,53350,0025, and 84.53300.0211 east of 19th Ave NE and south of County Road 133 by constructing a new industrial park with water main, sanitary sewer, storm sewer, storm water treatment, grading, and urban street improvements and to assess the benefited property for a portion of the cost of the improvement. AND WHEREAS, ten days’ mailed notice and two weeks’ published notice of the hearing was given, and the hearing was held thereon on the 18th day of March, 2019, at which all persons desiring to be heard were given an opportunity to be heard thereon, NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF ST. JOSEPH, MINNESOTA: 1. Such improvement is necessary, cost-effective, and feasible as detailed in the feasibility report. 2. Such improvement is hereby ordered as proposed in the council resolution adopted the 18th day of March, 2019. 3. SEH is here by designated as the engineer for this improvement. The engineer shall prepare plans and specifications for the making of such improvement. 4. The city council declares its official intent to reimburse itself for the costs of the improvement from the proceeds of the tax exempt bond. Adopted by the council on this 18th day of March, 2019. ________________________________ Rick Schultz, Mayor ________________________________ Judy Weyrens, Administrator RESOLUTION 2019-023 Resolution Approving Plans and Specifications and Ordering Advertisement for Bids 2019 Industrial Park Improvements WHEREAS, pursuant to a resolution passed by the City Council on February 19, 2019, a report has been prepared by Short Elliott Hendrickson, Inc. with reference to the proposed improvement County Road 133 between 19th Avenue NE and a point along CR 133 approximately 1,900 LF northeast of the intersection of 19th Avenue NE and County Road 13 by constructing water main and street improvements; and the improvement of portions of parcel 84.53794.0038 and undeveloped parcels 84.53350.0030, 84.53340.0027, 84.53340.0150, 84.53340.0132, 84.53350.0027, 84.53340.0130, 84,53350,0025, and 84.53300.0211 east of 19th Ave NE and south of County Road 133 by constructing a new industrial park with water main, sanitary sewer, storm sewer, storm water treatment, grading, and urban street improvements, and has presented such plans and specifications to the council for approval. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ST JOSEPH, MINNESOTA: 1. Such plans and specifications as presented on March 18, 2019 are hereby approved. 2. The City Administrator shall prepare and cause to be inserted in the official newspaper, the St. Cloud Times, an advertisement for bids upon the making of such improvement under such approved plans and specifications. The advertisement shall be published for two days, two consecutive weeks, shall specify the work to be done, shall state that bids be received by the City Administrator until , at which time they will be publicly opened at the St. Joseph City Hall, 75 Callaway Street East, by the City Administrator and City Engineer, will then be tabulated, and will be considered by the Council on at 6:15 PM in the Council Chambers, 75 Callaway Street East. Any bidder whose responsibility is questioned during consideration of the bid will be given an opportunity to address the council on the issue of responsibility, No bids will be considered unless sealed and filed with Administrator and accompanied by a cash deposit, cashier’s check, bid bond or certified check payable to the Administrator for 5% of the amount of such bid.
