Pursuant to due call and notice thereof, the Planning Commission for the City of St. Joseph met in a
regular session on Tuesday, November 13, 2018 at 6:00 PM in the St. Joseph Government Center
opening with the Pledge of Allegiance.
Plannina Commission Members Present: Commissioners Troy Goracke, Chad Hausmann, Matt Johnson,
' Steve Olson, Mike Ross, Daryl Schaefer, Community Development Director Therese Haffner
Members Absent: Gina Dullinger
Others Present: City Administrator Judy Weyrens
" Approval of the Aaenda: Olson made a motion to approve the agenda. The motion was seconded by
Johnson and passed unanimously by those present.
Approval of the Minutes: Schaefer corrected October 29, 2018 minutes stating he was absent. Goracke
made a motion to approve the minutes of October 8, 2018 and October 29, 2018 as amended.The
� motion was seconded by Schaefer and passed unanimously by those present.
� Public Hearing, Interim Use Permit, 219 Cedar St. E: Haffner stated that it was brought to the City's
� attention that Heim-Kins Rescued Treasure store was storing merchandise outdoors in their parking lot
. and their customers were parking in the adjacent Ace Hardware Store parking lot. A special use permit
was approved in 2009 for a seasonal outdoor market on Sundays only from May—October, while it did
not allow for outdoor storage of inerchandise. The special permit was issued prior to Heim-Kins taking
over the space and they have requested approval of an interim use permit to allow for outdoor storage of
merchandise on their front porch and a 240 square feet area on the westerly side of the building. The
applicant is proposing to operate year round on Saturday and Sundays and by appointment. A minimum
of 11 striped off-street parking spaces would be required. Haffner presented the Findings of Fact and
recommendation for consideration.
Commissioner Hausmann opened the public hearing.
Pat Kaeter, applicant and co-owner of Heim-Kins Rescued Treasures introduced herself. Gerri Feld,
applicant and co-owner of Heim-Kins Rescued Treasures introduced herself and stated they are looking
to display items for sale outside, not for storage.
Ross questioned property boundary and parking. Schaefer questioned drive area and 12 feet drive
access. Exhibits were displayed clarifying layout. Johnson questioned size of display of six feet wide by
40 feet long. Haffner stated that was correct.
As no one else present wished to speak, Hausmann closed the public hearing.
_ : Hausmann questioned signage. No new signage is proposed. There was discussion on parking. Olson
questioned the City's authority and enforcement of customers parking in the Ace Hardware parking lot.
Haffner indicated in reviewing the request before the Commission, it would be based on the use meeting
off-street parking. There was discussion on the expiration of the IUP to evaluate any issues. Consensus
was to recommend granting a five year interim use permit with a one year review by the Planning
. � Commission to evaluate.
� Johnson made a motion approving Findings of Fact and recommended granting a five year
interim use permit to allow for year-round outdoor display and sale of inerchandise at 219 Cedar
St. E with a review by the Planning Commission in one year to determine if the terms and
conditions of the permit are being complied with. The motion was seconded by Olson and passed
unanimously by those present.
Council Liaison Report: Goracke reported the City Council reviewed the proposed 2019 budget and
approved plantings in East Park.

AdJourn: Hausmann made a motion to adjourn the meeting at 6:17 PM.The motion was seconded
by Goracke and passed unanimously by those present.
