HomeMy WebLinkAbout[02] Minutes January 8, 2019 Page 1 of 1 Pursuant to due call and notice thereof, the City of St. Joseph and St. Joseph Township met in Joint session on Wednesday, February 13, 2018 at 7:00 PM at the St. Joseph Government Center, Members Present; Acting Chair Bob Loso. Members Chad Hausman, Steve Olson, Ralph Eiynck, Steve Gohman, Doug Fredrickson. City Administrator Judy Weyrens. Others Present: Steve Anderson, Joe Pfannenstein, Ann Reischl Minutes: Olson made a motion to approve the minutes of the February 13, 2018 and August 22, 2018 with correction to those present at the February 13 meeting; seconded by Eiynck and passed unanimously by those present. Conditional Use Permit, Franklin Outdoor Advertising: Acting Chair Loso called the hearing to order to which Weyrens stated the purpose of the hearing is to consider a Conditional Use Permit (CUP) to allow Franklin Outdoor Advertising to replace two existing billboards. The existing billboards have existed for many years and Franklin Outdoor Advertising is requesting to replace the existing signs with a monopole sign with upgrading LED Lightings. Stearns County Land Use requires a conditional use permit for the replacement. Weyrens clarified that the signs are not being converted to digital; rather a new frame with updated lighting. Joe Pfannenstein, Pfannenstein Signs approached the Board in support of the CUP. He stated that is important to support not only Franklin Outdoor Advertising, but the business who rely on signage. There being on one further wishing to speak; the public hearing was closed. Fredickson clarified that the same technology will be used only with updated lighting standards to which Weyrens affirmed. He further questioned if a building permit is required for the project. Weyrens stated that a building permit would be required and the permit would be issued by the City Building Official. Gohman made a motion authorizing issuance of a Conditional Use Permit to allow Franklin Advertising to replace existing billboards located adjacent to CR75 with the following conditions; seconded by Olson and passed unanimously by those present. 1. The applicant/property owner is responsible for meeting all Federal, State, and Local requirements, including but not limited to meeting the Stearns County Land Use and Zoning Ordinance, and the MN State Building Code and obtaining any and all permits and licenses. 2. Building permits must be obtained prior to the installation of the billboard signs. 3. Access shall be approved by Stearns County as the road authority and any required access permits shall be obtained from Stearns County. 4. The wetland shall not be permanently impacted. Pads must be used traverse over the wetland form CSAH 75 to the billboard sites. Caution shall be used that the heavy equipment used to install the billboards will not permanently impact the wetland. 5. The two billboard signs shall be located in the same location as the existing signs on the Subject Property. 6. Lighting shall be hooded or controlled and directed so as to not light adjacent properties and roadways. 7. Signage shall meet the requirements of Stearns County Ordinance 439. 8. Revocation: The Joint Planning Board shall revoke the conditional use permit if it determines that the terms and conditions of the permit as issued are no longer being complied with. A certified January 8, 2019 Page 1 of 1 copy of an order of the Joint Planning Board revoking the conditional use permit shall be filed with the County Recorder for recording. 9. Expiration: If within one (1) year after issuance of granting a conditional use permit the use permitted has not started, then the permit is null and void, unless the Joint Planning Board has approved a petition for an extension. The conditional use permit shall expire if the authorized use ceases for any reason for more than one (1) year. 10. The St. Joseph City Administrator and/or his/her designee shall have the right to inspect the Subject Property for compliance and safety purposes annually or at any time upon reasonable request.
