PREVIOUS PLANNING COMMISSION ACTION: BACKGROUND INFORMATION:Joe Space LLC, applicant and Rice Development of St. Cloud, owner, along with Strack Construction Companyhas submitted a request to rezone the property located on the northeast corner of CR 133 and Elm St. E, north of Central Minnesota Credit Union. The City’s future land use plan within the Comprehensive Plan guides the property for Corridor Commercial. Corridorcommercial includes a range of retail, entertainment, office, and service commercial development. The corresponding zoning district is B-2according the City’s Comprehensive Plan. The purpose of the rezoning request is to accommodate the future development of an office building. A rezoning toB-2 District is appropriate since the purpose is to make it consistent with the City’s Comprehensive Plan. Additionally, the surrounding properties are guided for Corridor Commercial and the propertiesto the south are zoned B-2 and include Central Minnesota Credit Union, CentraCare Clinic, Coborn’s Grocery Store, O’Reilly’s Auto Parts Store, and McDonalds. JOSEPH IN RE: FINDINGS OF FACT Application of Joe Space,LLCand Rice Development of St. CloudAND DECISION Rezoning of Lot 1, Block 1, Buettner Business Park 3 RESOLUTION ADOPTING FINDINGS OF FACTAND RECOMMENDING APPROVAL OF A REZONING OF CERTAIN PROPERTYFROM LI-LIGHT INDUSTRIAL TO B-2HIGHWAY 75 BUSINESS DISTRICT On April 8, 2019the St. Joseph Planning Commission conducted a public hearing at which all persons interested were given the opportunity to be heardto consider the application of Joe Space LLC,applicant and Rice Development of St. Cloud, owner for the rezoning of certain property to allow for development of an office building. The matter was duly published and notice was provided to property owners within 350feet of the above referenced property. WHEREAS,Joe Space, LLC, applicant and Rice Development of St. Cloud, ownerinitiated the rezoning on certain propertylocated eastof County Road 133and north of Elm Street East; and described as follows: Block1, Lot 1, Buettner Business Park 3,Stearns County, Minnesota “Subject Property” NOW THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF ST. JOSEPH, STEARNS COUNTY, STATE OF MINNESOTA, finds the following facts: 1.That Joe Space, LLC,and Rice Development of St. Cloud, hereinafter referred to as “Applicant,” properly applied for the rezoning for the Subject Property. 2. That the requested rezoning designation for the Subject Property is B-2 Highway 75 Business District. 3.That the future land use plan withinthe City of St. Joseph Comprehensive Plan guides the Subject Property for Corridor Commercial. 4.That the surrounding property is guided for Corridor Commercial. 5.That Corridor Commercial includes a range of retail, entertainment, office, and service commercial developments and the corresponding zoning district is B-2according to the City of St. Joseph Comprehensive Plan. 6. That the purpose for the zoning establishment is to make the land use map and zoning designation consistent and conforming. 7. That the properties to the south are zoned B-2 and include Central Minnesota Credit Union, CentraCare Clinic, Coborn’s, O’Reilly’s Auto Parts Store, and McDonald’s. 8.That a B-2 District permitted use, including but not limited to an office building would be compatible with the surrounding uses. 9. That the property is situated adjacent to aminor arterial (County Road 133) and access restrictions are in place by Stearns County road authority. BE IT FURTHER RESOLVED: That based on foregoing Findings of Fact, the Planning Commission of the City of St Joseph hereby recommends approval of the RezoningofBlock 1, Lot 1, Buettner Business Park3from LI –Light Industrial to B-2 Highway 75 Business District. Whereupon saidresolution was declared duly passed and adopted by the St. Joseph Planning Commission this 8th day of April, 2019. CITY OF ST.
