BACKGROUND INFORMATION:Strack Construction Company, ownerand applicant,has
submitted a request for a conditional use permit to allow for outdoor storagelocated on the southwest

corner of CR 133 and15Ave. NE, north of Bliss Direct Media and west of Best-Way Fabricating.The
Property is zonedLI-Light Industrial District and outdoor storage is a permitted accessory use via a
conditional use permit. Strack Construction Company recently received site plan approval to construct
their office building and garage. However, the proposed 16,900 SF outdoor storage area requires approval
of a conditional use permit. According to the applicant, the outdoor storage areawill be used to store their
equipment trailers, construction job office containers, and misc. steel materials.
The outdoor storage area is proposed to be fenced with a six foot high vinyl fencing with spruce trees and
bur oak along the north side and dogwood shrubs along the south side. The existing vegetation along the
southwesterly boundary of the property will provide screening.

FINDINGS OF FACT
On April 8, 2019,the St. Joseph Planning Commission conducted a public hearing to consider the
application Strack Construction Company Inc., ownerand applicant,for aconditionalusepermit for
outdoor storageonthe property legally described as follows:
That part of Lot 1, Block 1, BUETTNER BUSINESS PARK, according to the recorded plat
thereof, Stearns County, Minnesota, lying northerly of the following described line: Commencing
at the southeast corner of said Lot 1; thence North 00 degrees 34 minutes 30 seconds West,
assumed bearing, along the east line of said Lot 1, a distance of 326.90 feet, to the point of
beginning of the line to be described; thence South 89 degrees 25 minutes 30 seconds West,
581.59 feet, to the westerly line of said Lot 1 and said line there terminating.
“Subject Property”
The St. Joseph Planning Commission hereby adoptsthe following Findings of Fact:
1.That Strack Construction Company Inc., hereinafter referred to as “Applicant,” properly
applied for a conditionaluse permit to allow for outdoor storageon the Subject Property.
2.That the matter was duly published and notice was provided to property owners within 350
feet of the Subject Property.
3.That the Subject Property is zoned LI-Light Industrial and outdoor storage is a permitted
accessory use viaa conditional use permit.
4.That the surrounding land uses to the Subject Propertyare light industrial uses, including
warehousing.
5.That the outdoor storage area will be located in the rear of the Subject Property behind the
garage; therefore, theconditional use will not be detrimental to or endanger public health,
safety, morals, comfort, or general welfare of the neighborhood and will be harmonious to the
to the objectives of the Comprehensive Plan of the City.
6.That the conditional use will not involve activities, processes, materials, equipment and
conditions of operation that will be detrimental to any persons, property, or general welfare
because of excessive production of traffic, noise, smoke, fumes, glare or odors.
7.That a six foot vinyl fencing, along with trees and shrubs will screen the outdoor storage area;
therefore, theconditionaluse will be designed, constructed, operated and maintained so as to
be harmonious and appropriate in appearance with character of the area and isnot hazardous
or disturbing to existing or future neighboring uses.
8.That adequate utilities and services, including utilities, streets, drainage and other necessary
facilities have been provided and will not create excessive additional costs for servicesand/or
be detrimental to the economic welfare of the community.

9.That access will derive from 15Ave. NE.
10.That the proposed parking lot will provide sufficient off-street parking and loading space to
serve the proposed use.
11.That the conditional use will not resultin the loss or damage ofnatural, scenic or historic
featureand the soil conditions are adequate to accommodate the use.
DECISION
Based on the Findingsof Fact, the St. Joseph Planning Commission recommends the St. Joseph
City Council issue aConditionalUse Permiton the Subject Propertyto allowforoutdoor storageon the
following conditions:
1.The property owner is responsible for meeting all Federal, State, Local, and City
requirements and obtaining any and all permits and licenses.
2.The storage area shallbe constructed of bituminous or concrete meeting City Ordinance.
Adequate access for emergency vehicles shall be provided. The access width and
maneuvering areas will need to be reviewed for approval by the Fire Chief.
3.All lighting must meetCityOrdinance.Lighting (wall and pole) shall be full full-cut off or
shall be hooded or controlled in some manner so as to not light adjacent properties or the
roadway.
4.The storage area on the Subject Property shall not exceed 16,900 square feet.
5.The storage area on the Subject Property shall be accessory to the principle use; therefore,
storage ofequipment and material not used for the operation of the business is prohibited.
6.Storage of unlicensed and inoperable vehicles and equipment of any kind is prohibited
7.The storage area shall be fully screenedwith privacy fencing and trees, including being of
sufficient height to screen all equipment and material. Additional conifer trees will be
required to achieve screening if any equipment and material is visible.
8.Any treesand shrubsthat die shall be replaced within the current or next growing season.
9.The City shall have the right to inspect the premises for compliance and safety purposes at
any time upon reasonable request.
10.Revocation: The City Council shall revoke a conditional use permit when it determines that
the terms and conditions of the permit as issued are no longer being complied with. A
certified copy of an order of the City revoking a conditional use permit shall be filed with the
County Recorder for recording.
11.Expiration: The conditional use permit shall expire if the authorized use ceases for any reason
for more than one (1) year.
Whereupon said Findings of Fact and Decision was declared duly passed and adopted by the St. Joseph
