Members Present: Mayor Rick Schultz, Councilors Dale Wick, Bob Loso, Troy Goracke Anne Buckvold. Administrator Judy Weyrens. Citv Representatives Present: Finance Director Lori Bartlett, Community Development Director Therese Haffner, Public Works Director Terry Thene, City Engineer Randy Sabart, City Attorney Tom Jovanovich. Public Comments: No one present wished to speak. Approve Aaenda: Wick made a motion to approve the agenda removing item (c)Summary Publication from the consent agenda. The motion was seconded by Goracke and passed unanimously. Consent Actenda: Goracke made a motion to approve the consent agenda.The motion was seconded by Wick. a. Minutes—Approved the minutes of October 1,2018. b. Bills Payable—Approved check numbers 053925-053979, Payroll EFT#111571-111577 and Accounts Payables EFT#001848-001851. d. Premise Permit—Authorized the Mayor and Administrator to execute Resolution 2018-048 approving a Premise Permit to the St. Joseph Jaycees to conduct lawful gambling at Neighbors Route 75, 2010 Cry Rd 75. e. Donations—Accepted the donations for the purposes stated. f. Proclamation—Authorized execution of a resolution Declare November 11, 2018 as American Legion Centennial Day. g. Treasurer Report—Accepted the 3rd Quarter and September 2018 Financial Reports. h. Hire—Hired Madison Troska to staff the Community Center desk at$ 12.00 per hour. Summarv Publication: Wick stated that requested to remove it from the consent agenda so that it could discussed separately. Schultz made a motion authorizing execution of Resolution 2018-043 approving summary publication of the adoption of Ordinance 52.27 Rural Residential and amendments to Ordinances 502.54 and 502.62. The motion was seconded by Buckvold. Discussion:Wick stated he has concerns that the Ordinance does not address how all the services will be addressed such as Keg and Refuse. Weyrens stated that the Orderly Annexation Agreement will be attached as an appendix to the Ordinance and that agreement outlines the circumstances when services will be provided to rural areas. Ayes: Schultz, Loso, Buckvold. Nays: Goracke Abstain: Wick Motion Carried 3:1:1 Enqineer Reports: City Engineer Randy Sabart reported that work on the MN St W/CASH 2 has commenced. The majority of the work that will be completed this fall is near the interstate where the soil corrections were needed. As of this date all the tree clearing work has been completed. Committee Reports—Planninq Commission: Weyrens reported the Planning Commission conducted a public hearing to consider allowing a second curb cut for residential properties if the property is a corner lot and the roadway is not considered an arterial or collector. This matter came to the Planning Commission as a permit was issued in error to a builder that allowed two curb cuts. The Builder requested the Planning Commission reconsider the Ordinance provisions. Schultz questioned if existing properties on corner lots would be allowed the same privilege. Weyrens responded that if the Council adopts the Ordinance Amendment, it would apply to all properties in the City. Loso clarified that the provision would not apply to properties abutting a collector or arterial. October 15, 2018 Page 2 of 2 Wick stated that when he read the application for the amendment, it was requested to allow as long as one of the curb cuts is not on a major arterial road,freeway, highway or county road; however now the language has been changed to include only the prohibition on collector or arterial classifications. Wick questioned why the language was changed. Community Development Director Therese Haffner stated that the applicant had submitted a proposed amendment to which staff reviewed and modified before the public hearing. She further clarified that the City Engineer has reviewed as well. Wick stated the reason he is requesting clarification is that even if the Council accepts the recommendation of the Planning Commission, the property in question would not be allowed a second curb cut as one of the roads is classified as a collector street. Wick questioned if the language could be allowed to prohibit on community collector and arterial roads. City Engineer expressed concern with giving blanket approval as streets such as 12�h Avenue is a neighborhood collector and any access should be reviewed. He suggested adding subject to Engineer review for sight distance and corner distance. Schultz questioned if adding subject to approval is subjective leading to further issues. Loso questioned if it could be simplified to allow based on City Engineer approval. Weyrens stated that if there are roads such as arterials that the Council would not allow access, it should be identified so property owners don't think they just need approval. Loso questioned if all roads aren't classified as an arterial or collection to which Sabart responded no, the City also has local roads which have a lower traffic design. Loso also questioned if this same provision should be a!lowed to all zoning districts rather than R1, Single Family. Sabart stated that Commercial and Industrial projects have considerable review and access is part of the review process. Made a motion authoring the Mayor and Administrator to execute Resolution 2018-046 amending Ordinance 502.10 Parking, and authorizing summary publication of the same with the following language change: ...except that single family corner lots may be a/lowed a second curb cut on the side of the intersecting street of a neighborhood collector or local residential street. Such curb cut access shall be prohibited on arterial and community collector streets. The motion was seconded by Schultz and passed unanimously. Buckvold questioned if safety is a concern. Sabart responded that this where he has some concerns. For example, the City would not want a driveway 10 feet before a stop sign. Wick stated that property owners will still have to go through a review process. Haffner stated that a driveway curb cut would be required, triggering review. Administrator Reqorts—Performance Measures: Weyrens reported that in 2010 the legislature passed a statute allowing cities to participate in a standard measures program inviting community members an opportunity to comment on performance. Participating cities receive$.014 per capita reimbursement. The State Auditor's Office has identified 10 minimum benchmarks for questions that must be used. If the Council would like additional questions they may be added. In the past the City has conducted the survey in spring, this year staff has requested to conduct in November. Loso made a motion to conduct the annual Performance Measure Survey with the assistance of the League of MN Cities. The motion was seconded by Wick and passed unanimously. Mayors Report: The St. Joseph Committee working with the Lodging Tax has been meeting and they will be reporting to the EDA. Schultz stated that he met with the principal from Kennedy and she indicated that the drop off and pickup has been going better this year. Closed Session: Schultz made a motion to go into closed session pursuant to MN Statute 13D.05 Subd. 3(b) regarding pending litigation with the College of St. Benedict. The motion was seconded by Wick and passed unanimously.
