HomeMy WebLinkAbout[08c] Lobby Services (08C1 Cm-MS T,J f:PH Council Agenda Item MEETING DATE: June 3,2019 AGENDA ITEM: Lobby Services SUBMITTED BY: Administration BOARD/COMMISSION/COMMITTEE RECOMMENDATION: N/A PREVIOUS COUNCIL ACTION: The City has hired DeLaforest Consulting LLC for the past two legislative sessions to help support and promote the City bonding requests. BACKGROUND INFORMATION: During the 2017 Legislative Session the City was successful in securing from the House for support of the Pedestrian Crossing;however it did not make the Senate. In the 2018 Legislative Session the City received hearings for the Jacob Wetterling Recreation Center and East Park,with the House supporting the Jacob Wetterling Recreation Center. As everyone is aware the Senate did not include any bonding for projects. Chris DeLaForest has submitted a proposal to start the process now for the next legislative session under the same terms and conditions of the current contract. Our current contract expires shortly. DeLaForest Consulting would be pleased to extend the contract another calendar year, upon the same terms and conditions as the current contract. There is little doubt that the 2020 legislature will pass a robust bonding bill, likely in excess of $1 billion. As you know, that bonding cycle will commence shortly, with MMB issuing bonding request instructions to local governmental units. After that, the summer will consist of legislative fundraisers, that will give us an opportunity to continue to lobby for our priorities. In the Fall, the administration and each bonding committee will tour proposed projects across the state, with the Saint Cloud area surely on the itinerary. th On February 11, 2020 the legislature will convene the 2020 session. RECITALS WHEREAS,the Client wishes to purchase professional legislative and lobbying services to assist in promoting its interests; and, WHEREAS, Consultant has represented that it has the experience, knowledge, and contacts to effectively provide professional legislative and lobbying services and is able to provide such services. NOW,THEREFORE,for good and valuable consideration,the parties to this Agreement make the following promises and covenants: AGREEMENT Services to be Provided. Consultant shalt furnish to Client, in accordance with the terms of this Agreement, provide professional lobbying and legislative services before the Minnesota Legislature in furtherance of the Client's interests during the 2018 legislative session. 1. Consultant shall devote the time necessary to provide the following services: a. Assist Client in securing capital investment appropriations during the 2018 legislative session for three projects known as 1) "County 75 pedestrian crossing"; 2) "Wetterling Community Center";and 3) "East Park"; b. Educate and persuade key legislators and staff regarding Client's proposed legislation, including caucus leadership, capital investment committee chairs, and key staff in the Dayton Administration; c. Assist in drafting legislation and securing authors and co-authors; d. Assist in committee testimony and project presentation before the legislature. 2. Compensation to Consultant. In consideration of the services to be performed by Consultant pursuant to this Agreement, Client agrees to make payment to Consultant in the amount of ten- thousand ($10,000) dollars total,which shall be payable upon invoice in $2,500 installments on the following 2018 dates: March 1st,April 1st, May 1st, and June 1st. 763-439-1178 chris@delaforestconsulting.com /www.delaforestconsulting.com 15806 Linnet Street NW, Andover, MN 55304 3. Required Filings. Reports. Consultant shall prepare and timely file all required filings and reports with the Minnesota Campaign Finance and Public Disclosure Board and any other filings or reports required by law. 4. Rescission. Either party may rescind the Agreement upon a 15-day written notice to the other party. Consultant shall be paid, pro-rata,for all work completed through the date the rescission notice was received. 5. Confidentiality. Consultant agrees that all information provided to Consultant by Client other than information which is publicly available or expressly designated by Client as non- confidential, is confidential and proprietary to Client. Consultant agrees not to use any such confidential information other than as necessary to render the services under this Agreement and shall not disclose such confidential information to any third party during the term of this Agreement and thereafter. 6.Term. Notwithstanding the date of signatures of the parties to this Agreement,the term of this Agreement shall be from March 1st, 2018 to May 31st, 2018. 7. Amendment. This Agreement may be amended by mutual, written agreement of the parties. 8. Complete Agreement.This Agreement memorializes the complete agreement between the parties.Any other promises, declarations, or representations,whether oral or written, are null and void. 9. Sub-Contracting. The Consultant, at its sole discretion and expense, may retain other lobbyists or professionals under a sub-contract to assist in delivering services to the Client.
