HomeMy WebLinkAbout[05] 2019 Street Improvment Council Agenda Item \[05\] MEETING DATE: June 17, 2019 AGENDA ITEM: Reports – 2019 Street Improvement SUBMITTED BY: City Engineer/City Attorney/Administration BOARD/COMMISSION/COMMITTEE RECOMMENDATION: PREVIOUS COUNCIL ACTION: The City Council on February 4, 2019 ordered the 2019 Street Improvement Project and subsequently ordered the solicitation of bids and the preparation of a benefit analysis to support the proposed assessments. BACKGROUND INFORMATION: The 2019 Improvement Project includes utilization of MSA funds which requires plan approval by MnDot. The project is waiting final approval from MnDot and is ready to place for bids. Due to the timing of the project, the assessment hearing will be conducted before the bids are received, using the preliminary assessment roll. Included with the information is the revised assessment roll which includes application of the Benefit Analysis. The assessment hearing is scheduled for July 10 at 6:00 PM. RESOLUTION 2019-042 RESOLUTION ORDERING ASSESSMENT HEARING 2019 Street Improvement Project WHEREAS, by a resolution passed by the council on June 17, 2019, the city clerk was directed to prepare a proposed assessment of the cost of Improvement No. STJOE147693, improving 12th Avenue SE between a point 250 feet north of E Baker Street and a point 250 feet south of Dale Street, Pond View Lane E between E Baker Street and Dale Street, 13th Avenue SE cul-de-sac south of E Baker Street, E Baker Street between a point 250 feet west of 12th Avenue SE and 16th Avenue SE, Callaway Street E between 12th Avenue SE and Pond View Lane E, Cary Court cul-de-sac east of 12th Avenue SE, Cedar Court cul- de-sac east of Pond View Lane E, Dale Street E between a point 250 feet west of 12th Avenue SE and 16th Avenue SE, 4th Avenue NE between County State Aid Highway (CSAH) 75 and Minnesota Street E, 4th Avenue SE between Minnesota Street E and E Baker Street, 1st Avenue NW between CSAH 75 and Minnesota Street W, Birch Street W between 2nd Avenue NW and College Avenue N, Ash Street W between 2nd Avenue NW and College Avenue N, and Jade Road between County Road 121 and the south City limits at Interstate 94, and WHEREAS, the Administrator has notified the council that such proposed assessment has been completed and filed in his/her office for public inspection, NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF ST. JOSEPH, MINNESOTA: 1. A hearing shall be held at 6:00 p.m. on July 10, 2019, in the city hall located at 75 Callaway St E, St. Joseph, MN 56374 to pass upon such proposed assessment. All persons owning property affected by such improvement will be given an opportunity to be heard with reference to such assessment. 2. The City Administrator is hereby directed to cause a notice of the hearing on the proposed assessment to be published once in the official newspaper at least two weeks prior to the hearing, and he/she shall state in the notice the total cost of the improvement. She shall also cause mailed notice to be given to the owner of each parcel described in the assessment roll not less than two weeks prior to the hearing. 3. The owner of any property so assessed may, at any time prior to certification of the assessment to the county auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the City Administrator, except that no interest shall be charged if the entire assessment is paid within 30 days from the adoption of the assessment. An owner may at any time thereafter, pay to the City Administrator the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. Such payment must be made before November 15 or interest will be charged through December 31 of the succeeding year. Adopted by the City Council of St. Joseph, this day of , 2019 Rick Schultz, Mayor ATTEST Judy Weyrens, Administrator RESOLUTION 2019-043 RESOLUTION DECLRING COSTS TO BE ASSESSED AND ORDERING PREPARATION OF PROPOSED ASSESSMENT 2019 Street Improvement Project WHEREAS, by a resolution passed by the council on June 17, 2019, the city clerk was directed to prepare a proposed assessment of the cost of Improvement No. STJOE147693, improving 12th Avenue SE between a point 250 feet north of E Baker Street and a point 250 feet south of Dale Street, Pond View Lane E between E Baker Street and Dale Street, 13th Avenue SE cul-de-sac south of E Baker Street, E Baker Street between a point 250 feet west of 12th Avenue SE and 16th Avenue SE, Callaway Street E between 12th Avenue SE and Pond View Lane E, Cary Court cul-de-sac east of 12th Avenue SE, Cedar Court cul- de-sac east of Pond View Lane E, Dale Street E between a point 250 feet west of 12th Avenue SE and 16th Avenue SE, 4th Avenue NE between County State Aid Highway (CSAH) 75 and Minnesota Street E, 4th Avenue SE between Minnesota Street E and E Baker Street, 1st Avenue NW between CSAH 75 and Minnesota Street W, Birch Street W between 2nd Avenue NW and College Avenue N, Ash Street W between 2nd Avenue NW and College Avenue N, and Jade Road between County Road 121 and the south City limits at Interstate 94, and 1. The portion of the cost of such improvement to be paid by the city is hereby declared to be $ 1,240,100 and the portion of the cost to be assessed against the benefited property owners is declared to be $ 981,700. 2. Assessments shall be payable in equal annual installments extending over a period of ten (10) years, the first of the installments to be payable on or before the first Monday in January 2020 and shall bear interest at the rate of 4.5% per annum from the date of the adoption of the assessment resolution. 3. The City Administrator, with the assistance of the City Engineer (consulting engineer), shall forthwith calculate the property amount to be specifically assessed for such improvement aginst every assessable lot, piece or parcel of land within the district affected, without regard to cash valuation, as provided by law, and she shall file a copy of such proposed assessment in her office for public inspection. 4. The City Administrator upon the completion of such proposed assessment, notify the Council thereof.
