Pursuant to due call and notice thereof, the City Counci{for the City of St. Joseph met in special session
on Wednesday, July 10, 2019 at 6:00 PM at the St. Joseph Government Center, opening with the pledge
of allegiance.
Members Present: Mayor Rick Schultz. Councilors Brian Theisen, Bob Loso, Troy Goracke.
Administrator Judy Weyrens.

Public Hearinq—2019 Street Imqrovement Proiect: Mayor Schultz opened the public hearing at 6:01 PM
at which time Weyrens stated the purpose of the hearing is consider assessing a portion of the costs for
the 2019 Street Improvement Project to adjacent property owners.
City Engineer Sabart provided a summary of the project and associated costs. The 2019 Street
Improvement includes six separate street sections and includes mill and overlay and reconstruction. The
project has been bid with the City receiving three(3) bids. The bid process did identify Jade Road as an
alternative in the event the Council desired to have continued discussion on the merits of the
improvement. The total estimated final cost is$2,211,500.
As part of the assessment process, the City had prepared a benefit analysis report to provide guidance
on the benefit that is derived from the project. The report was prepared by Nagell Appraisals. The report
identifies each project by section and range of benefit. The information from this report has been applied
to the assessment roll and if the preliminary assessment that was prepared prior to project design is
higher than the benefit identified in the report, a column entitled City Subsidy has been added. The
subsidy is the amount of the assessment that is above the maximum benefit. Not all properties have a
subsidy, only those where the proposed assessment was higher than the benefit identified in the analysis
report.
Assessments may be paid in annual installments over a specified amount of time. For this project, the
term is ten years with an interest rate of 4.5°to. No interest will be charged if the special assessment is
paid in full within 30 days of the adoption of the assessment roll, close of business on August 9, 2019.
The first installment is payable on or before the first Monday in January 2020. If not prepaid, the
payments will be collected with the property taxes.
Weyrens stated that three letters of appeal have been received from Mike Deutz, Joe and Joanne
Bechtold, and Shirley Hove.
Steve Windingland, behalf of Shirley Hove: Windingland questioned what the future use of Jade Road is
and whether they would have to pay for repairs again once the land is developed. Additional concerns
were expressed regarding how the assessment was calculated. The property owned by Hove is
undeveloped and the future land use is uncertain. Windingland stated the amount being assessed is just
over 20% of what the entire property is worth and doesn't believe the property will increase in value by
the amount they are being assessed.
Loretfa Angell, 203 16�h Ave SE: Angell stated 16t"Avenue was just done a few years ago and now her
property is being assessed again for the other portion of her lot. Angell questioned whether the portion of
the street that has been redone will be done again. Sabart stated she is not being assessed again on the

previously reconstructed 16�h Avenue portion; rather, on the side that is going to be constructed with these
improvements.
Dick Taufen, 32 2"°'Ave NW:Taufen questioned if there are going to be improvements to the drainage
adjacent to his property.
Sabart stated that improvements are included to improve drainage allowing for additional flow to
the north. Taufen questioned what tonnage the road will be constructed for. Sabart stated where the
roads are being reconstructed, they will be to nine-ton construction.Taufen added that he has lived at the
property for fifty years and this is his fourth assessment on the property.
Jerry Baggenstoss, 503 College Ave N: Baggenstoss questioned why he is being assessed on his
second property at 514 College Ave as there are no improvements to be done on that property.
Sabart stated he will look up the property and follow up with Baggenstoss to confirm assessment
amounts.
Bill Elfering, 329 Cypress Drive: Elfering stated he has lived at the property for 30 years and this is his
second assessment on the property with the last being about 15 years ago. Elfering questioned the policy
on when streets need to be reconstructed. Sabart stated Cypress Drive was constructed in 1975 and has
been seal-coated many times with one overlay.
Mike Deutz: Deutz approached the Council having six properties included in the improvements. Deutz
questioned the methodology on street assessments. Deutz finds it hard to believes that his properties will
increase by the values he is being assessed. Deutz stated one property along Old HWY 52 is
undevelopable. The appraised value is$12,000 and he is being assessed $12,000.
Sabart stated that overlays are not done on streets that are in dire need of repairs. Once a street
is constructed, maintenance work is needed over the life of the street in order to get the street to that 30-
year life mark.An overlay is a requirement in order to extend the life of the road.
Diane Muske, 313 Cypress Drive: Muske stated she has to relocate the sewer from the back of the home
to the front of the home and questioned why that amount was not included on her assessment notice.
Sabart stated that the portion of the pipe that runs from the home and connects to the City pipe is
privately owned by the property owner. The City is will reimburse up to$2,000 in sewer connection costs��
that the homeowner will incur to have their sewer piping fun to the front of the property to connect to city
services.
Andy Lahr, 127 12"'Ave SE: Lahr stated he is being assessed on 1 Z`h Ave SE and Baker St E. Lahr
questioned whether the sidewalks will need to be fixed in a few years and would prefer having the street
repairs be delayed until all the improvements can be done at the same time.
Sabart stated that typically sidewalks are not repaired unless complete street reconstruction is
done or if a petition were to be received from property owners to repair.
Marv Feld, 417 College Ave N: Feld stated Elm Street is on the northern portion of his lot and asked for
further clarification on what improvements are going to be done on Elm Street,
Sabart responded that the improvements include utility and complete street reconstruction.
Joe Bechtold, 28263 Jade Road: Bechtold submitted a letter to the Council and would like that to be part
of the public hearing. Bechtold added that there are only three properties along Jade Road that are being
assessed and that the road is being used by many other people. The property owners use the road
minimally. Bechtold is also concerned about being assessed again once property along Jade road is
developed.
Sfeve Windingland asked if communication can still be had between property owners and the city after an
assessment appeal is filed.
City Attorney Tom Jovanovich stated that communication can still occur.

MaryBeth Munden, 12th Ave SE: Munden asked why her assessment costs increased since the last
hearing in February and why the project contingency has decreased.
Sabart stated that product pricing has increased since that time which would have increased her
assessment amount. Regarding the contingency, the amount was reduced in order to put more money
towards project costs.
Karl Berg, 208 12`h Ave SE: Berg questioned why he is being assessed for$6,700 when others near him
have a cap of$3,000.
Sabart believed Berg's property was in the are that had an $8,000 cap and will connect with Berg
after further review.
As no one else present wished to speak, Schultz closed the public hearing.
Jovanovich stated the City has options regarding the assessment objections. The assessment can still be
approved while pulling certain properties aside for further review. Jovanovich recommended pulling
Bechtold's and Hove's properties from assessment approval. Sabart stated he would like to add Mike
Deutz's property that is undeveloped to the list of those being pulled for further review.
Loso made a motion authorizing the Mayor and Administrator to execute Resolution 2019-046
Adopting Final Assessments for the 2019 Street Improvement Project, excluding the following
parcels 84.53300.0320, 84.53300.0321, 84.53725.0005 for continued discussion and to reconvene
the hearing for those parcels on August 19, 2019. The motion was seconded by Schultz and
passed unanimously by those present.
Adiourn: Loso made a motion to adjourn at 7:30 PM; seconded by Goracke and passed
unanimously.
