Pursuant to due call and notice thereof, the City Council for the City of St. Joseph met in regular session
on Monday, October 21, 2019 at 6:00 PM at the St. Joseph Government Center, opening with the pledge
of allegiance.
Members Present: Mayor Rick Schultz. Mayor Rick Schultz, Councilors Anne Buckvold, Brian Theisen,
Bob Loso, Troy Goracke. City Administrator Kris Ambuehl
City Representatives Present: City Engineer Randy Sabart, Police Chief Dwight Pfannenstein, Finance
Director Lori Bartlett, Public Works Director Terry Thene, Community Development Director Therese
Haffner, Administrative Services Coordinator/Deputy Clerk Kayla Klein
Others Present: Janice Mensinger, John Fahning
Pack 84 Cub Scout Recognition: Schultz thanked the Cub Scouts in attendance for cleaning up
Millstream Park. Schultz presented the Pack with a Certificate of Appreciation.
Public Comments: NA
Approve Agenda: Loso made a motion to approve the agenda. The motion was seconded by
Theisen and passed unanimously.
Consent Agenda: Schultz made a motion to approve the consent agenda with the minute
corrections as noted by Buckvold; seconded by Theisen and passed unanimously.
a. Minutes – Approved the minutes of October 7, 2019.
b. Bills Payable – Approved check numbers 055245-055289, and Payroll EFT #111752-111759 and
Accounts Payable EFT #001899-001902.

c. Financial Report – Approved the 3 quarter financial report and the September 2019 financial
report as presented.
d. Bike Share Program Agreement – Approved the Bike Share Program Agreement between the
Cities of St. Joseph and Waite Park authorizing the Mayor and Administrator to execute the
agreement.
e. Issued a 2-month tobacco license for Dollar General #20717.
f. Change Order No. 1 – Approved change order no. 1 for the 2019 Street Improvement Project.
g. Liquor License – Approved the off-sale liquor license and authorized the Mayor and Administrator
to execute Resolution 2019-065 approving the on-sale liquor license for Krewe Restaurant
contingent upon the successful completion of a background check.
Caribou Coffee Conditional Use Permit (CUP): Haffner reported the applicant is requesting approval of a

Conditional Use Permit to allow for a drive-thru coffee shop at the corner of 12 Ave SE and CSAH 75. At the

September 16 Council meeting, the variance of nine feet was granted and the Council directed the city
engineer and attorney to review the findings of fact for the CUP and bring back for further consideration.

City Engineer Sabart presented and discussed two exhibits showing striping along 12 Ave SE. Exhibit two
includes having a left turn lane into Caribou coming from the north and a left turn lane into Scherer Trucking
coming from southerly traffic. Exhibit three showed what is currently in place, without the left turn lanes.
Buckvold suggested the garbage be placed further away from the residential homes as well as having
additional barriers for the neighbors to reduce sound.
City Attorney Kadlec stated the property has not been purchased yet, but the agreement has been executed.
The buyer can opt out or can continue through with the purchase.
Snow removal was discussed and it was determined that there is adequate spacing for snow removal on the
eastern portion of the lot.
Schultz contacted the St. Cloud APO and requested crash data at the intersection of CSAH 75 and County
Road 133. Over the past ten years, there have been 118 crashes, about 12 a year. Schultz is concerned with
the additional traffic that will be added if the Caribou is put in that intersection.

Theisen believes the amount of crashes at that intersection will double if the Caribou is approved.
Schultz and Theisen did not think the lines added in Exhibit 2 that Sabart presented would reduce crashes.
Further discussion was held on whether development at an intersection would cause people to be more
cautious knowing there would be an increase in traffic.
Loso made a motion authorizing the Mayor and Administrator to execute Resolution 2019-052 Adopting
Findings of Fact and Approving a Conditional Use Permit for the Purposes of having a Drive Thru
Coffee Shop, with the addition of Exhibit B. The motion was seconded by Goracke.

Schultz made a motion authorizing the Mayor and Administrator to execute Resolution 2019-055
Adopting the Findings of Fact Supporting the Denial of a Conditional Use Permit for the Purposes of
Having a Drive Thru Coffee Shop. The motion was seconded by Theisen.

Abstain: Loso
Interim Use Permit Request – 26 Birch St W: Haffner stated an Interim Use Permit request was submitted by
the Loso Family to allow for a non-owner occupied residential rental at 26 Birch St W. The Planning
Commission reviewed the request and unanimously recommended approval of the request. The IUP request is
for six years and will expire on October 12, 2025.
Schultz made a motion authorizing the Mayor and Administrator to execute Resolution 2019-064
Adopting Findings of Fact and Approving an Interim Use Permit for the Purposes of a Non-Owner
Occupied Residential Rental. The motion was seconded by Goracke.

Ordinance Amendment – Ordinance 701: Ordinance 701 Licensing and Regulation of Consumption of
Intoxicating Liquor limits the number of on-sale liquor license to six. Additional licenses can be issued by
resolution of the City Council only. Staff is requesting the number of on-sale liquor licenses be increased to ten.
Loso made a motion authorizing the Mayor and Administrator execute Ordinance 2019-01 Amending
Section 701.19 of Ordinance 701 Licensing and Regulation of Consumption of Intoxicating Liquor. The
motion was seconded by Theisen and passed unanimously.
Engineer Reports, Capital Improvement Plan Discussion: Sabart presented the potential Capital Improvement

Projects for 2020. The projects include: Street Overlays, Minnesota Streetscaping, 18 Avenue Improvements,
th
20 Avenue Se to Dale Street Improvements, Millstream Parking Lot Improvements, Welcome Monument
Signs, Baseball Parking Lot Improvement, Trail Maintenance, and Alley Improvements. The street

improvements would include streets in the Northland Area, MN Street, College Avenue, and 19 and 20
Avenue SE.
Sabart and Thene would like the Council to review the list and come up with their priorities for 2020.

Schultz asked whether the construction of the 20 Ave SE improvements will be based on the outcome of the
grant for the low income housing project.

Thene stated the request is to have the 1 section of 20 completed due to the road being deteriorated from

traffic. The 2 section can be improved contingent upon the grant approval. A portion of the street costs will be
assessed to the abutting property owners.

Birch Street East is not in great shape; however, the alley running parallel to Birch Street is used more than
Birch Street. Discussion was had on whether to pave the alley being it is used more. If the alley is paved, it
would require more maintenance to upkeep. At that point, should the alley be widened and improved the same
way a street would.
Buckvold suggested converting Birch Street to a bike lane and extend it along CSAH 75. Buckvold also
suggested redoing College Avenue and holding off on Birch Street and the alley improvement.
Bartlett is working on the Enterprise and CIP portions of the budget. At this point, without taking into account
street assessment or other forms of revenue, Bartlett anticipated $950,000 in improvements.
Council consensus was to have a work session to discuss the CIP. The work session was tentatively set for
November 7, 2019.
Department Head Report, Administration: Ambuehl has been working on union contracts and filling the Finance
Technician and Custodian positions.
Department Head Report, Community Development: Haffner reported the Planning Commission has been

reviewing the City’s rental ordinance. The Bike Share system arrived October 1 and St. Joseph partnered with
Waite Park with both cities having docking stations. The St. Joseph CVB has been marketing businesses,
recreational events throughout the City on their Facebook page.
Department Head Report, Finance: Bartlett reported staff will be reviewing applications for the Finance
Technician and interviews will be conducted shortly. The Community Center has open gym on Tuesdays,
Wednesdays, and Thursdays from 6-9PM and on Saturdays 9-Noon at a cost of $2 a time. Compost permits
are still on sale. Bartlett is currently working on the enterprise budget and will have before the Council in
November. Stearns County sent over the initial tax capacity rates. The taxable market value decreased from
what was anticipated from 12% to 9%. Park scheduling has increased from previous years. The City offers
three year-round facilities for rent: The Community Fire Hall, Millstream Park Pavilion, and the Lake Wobegon
Trailhead.
Department Head Report, Police: Pfannenstein reported the department is working on their year-end training
and the department had to work with a few residents that had large amounts of garbage for the curbside
collection. Pfannenstein suggesting having a discussion at work session to see what changes can be made in
the future.
Department Head Report, Public Works: Thene reported that hydrant flushing has been completed and
street-sweeping will begin shortly. The department is prepping their vehicles for winter.
Mayor Reports: No reports.
Adjourn: Theisen made a motion to adjourn at 7:19 PM; seconded by Schultz and passed
unanimously.
