It adds Subd. 4 Educational and Ecclesiastical. The purpose of the addition is to state how each use in an EE Zoning District will be charged for Street Lights. Motion 2: Approve Ordinance 2019-05 Summary Ordinance (Supermajority Required). ORDINANCE NO. 2019-05 AN ORDINANCE AMENDING SECTION 407.03 OF ORDINANCE 407 STREET LIGHT ORDINANCE The City Council for the City of St. Joseph HEREBY ORDAINS That Section 407.03 of the St. Joseph Code of Ordinances is hereby amended as follows: Section 407.03: UTILITY FEES AND CHARGES. The utility shall charge utility fees established from time to time by the City Council to recover from all property owners any debt service and operation and maintenance of the street lighting system facilities in the City. All property owners in the City of St. Joseph will be billed a proportionate share of the operation and maintenance of a city-wide street lighting system. The proportionate share of the utility shall be equated to a charge per unit and the unit charges shall be applied as follows: Subd. 1: Residential Uses – including single family, two family, three family and Manufactured Home Community Park and dormitories shall be billed one unit for each residential use. For the purposes of determininged a residential unit, each apartment, dormitory room or individual living unit shall be charged one unit per month. The number of units will be multiplied by the monthly rate. Subd. 2: Commercial/Industrial Uses – each use shall be charged one unit. For the purpose of determining a commercial/industrial unit, each business in a multi-tenant building will be charged one unit per month. The number of units will be multiplied by the monthly rate. Subd. 3: Mixed Use Facility – each use in a multi-use building shall be charged one unit. If the facility includes living units, each living unit shall be charged one unit per month and each individual business shall be charged one unit per month. The number of units will be multiplied by the monthly rate. Subd. 4: Educational and Ecclesiastical – each use in an educational and ecclesiastical district shall be charged 2/3 of one unit for each residential useunit. For the purposes of determining a residential unit, each apartment, dormitory room or individual living unit shall be chargedconsidered one unit per month. The number of units will be multiplied by 2/3 the monthly residential unit rate. Subd. 45: Exemptions. The following land uses are exempt from the established Street Light Utility Charge: a) Public street right-of-way b) Publicly owned property c) Parks, open spaces d) Cemeteries e) Agricultural, Undeveloped st This amendment is adopted this 21 day of October, 2019 and shall be effective upon publication. ORDINANCE NO. 2019-05 AN ORDINACE AMENDING ORDINANCE 407 STREET LIGHT UTILITY The following official summary of the ordinance referred to has been approved by the City Council of St. Joseph as clearly informing the public of the intent and effect of the amendments. Section 407.03 – Utility Fees and Charges The purpose of the amendment is to make grammar changes in Subd. 1 and to add Subd. 4: Education and Ecclesiastical in order to regulate the charges for street light utilities in the EE Zoning District. A printed copy of the entire ordinance is available for inspection by any person at the office of City Clerk, Monday through Friday between the hours of 8:00 a.m. and 4:30 p.m. or on the City’s website at www.cityofstjoseph.com.
