STAFF RECOMMENDATION: Approve Release of Developer Agreement
PREVIOUS COUNCIL ACTION:
BACKGROUND INFORMATION: In 2012,the City entered into a Developer Agreement upon final
plat approval of St. Joseph Professional Plat. The realtar on behalf of the property owner of McDonald's
has requested the property be released from the Developer Agreement.The subdivision is fully developed
and has complied with all of the terms of the Developer Agreement.

REQUESTED COUNCIL ACTION: Authorize the Mayor and City Administrator to execute of the
Release of Developer Agreement for St. Joseph Professional Plat.
RELEASE OF DEVELOPER AGREEMENT
WHEREAS, the City of St. Joseph, a municipal corporation of the State of
Minnesota ("City") is a party to that certain Developer Agreement dated February 27,
2012, recorded March 14, 2012, as Document No. A1364364, relating to ST JOSEPH
PROFESSIONAL PLAT (the "AgreemenY'); and
WHEREAS, the agreements and obligations of the parties to the Agreement
have been fully performed and satisfied.
NOW, THEREFORE, for good and valuable consideration, the receipt and
sufficiency of which is hereby acknowledged, the City hereby releases and terminates
the Agreement.
IN WITNESS WHEREOF, the City has executed this Release of Developer
Agreement effective as of the date listed below.
