Pursuant to due call and notice thereof, the City Council for the City of St. Joseph met in regular session
on Monday, December 16, 2019 at 6:00 PM at the St. Joseph Government Center, opening with the
pledge of allegiance.
Members Present: Mayor Rick Schultz. Mayor Rick Schultz, Councilors Anne Buckvold, Brian Theisen,
Bob Loso, Troy Goracke. City Administrator Kris Ambuehl
City Representatives Present: City Engineer Randy Sabart, Police Chief Dwight Pfannenstein, Public
Works Director Terry Thene, Community Development Director Therese Haffner
Public Comments: NA
Approve Agenda: Loso made a motion to approve the agenda with the addition of item 4f, Release
of Developer Agreement; seconded by Schultz and passed unanimously.
Consent Agenda: Goracke made a motion to approve the consent agenda items; seconded by
Theisen and passed unanimously.
a. Minutes – Approved the minutes of December 2, 2019.
b. Bills Payable – Approved check numbers 055443-055504 and Payroll EFT #111781-111787 and
accounts payable EFT #001906-001907.
c. Donations – Accepted the donations and contributions as presented.
d. Financial Report – Approved the November 2019 Financial Report as presented.
e. Liability Insurance – Authorized the Administrator to execute the LMCIT Liability Coverage Waiver
Form verifying that the City does not waive the monetary limits on tort liability.
f. Release of Developer Agreement – Authorized the Mayor and Administrator to execute the
Release of Developer Agreement for St. Joseph Professional Plat.
Public Hearing, Vacation of Utility Easement, 612 MN St E: Schultz opened the public hearing.
Haffner reported she had received a request from the property owner to vacate the sanitary sewer easement
on his property. The property was platted in 1960 and an easement over the entire property was granted only
for the sanitary sewer system to the City in 1972. A sanitary sewer pipeline is located along the westerly
boundary of the property. Both the City Engineer and Public Works Director have reviewed the request and
have verified that the vacation is acceptable provided a new drainage and utility easement of 10 feet along the
westerly boundary is dedicated back to the City.
Schultz closed the public hearing.
Goracke made a motion authorizing the Mayor and Administrator to execute the Permanent Drainage
and Utility Easement Agreement accepting the easement and Resolution 2019-070 approving the
vacation of a Sanitary Sewer Utility Easement. The motion was seconded by Loso and passed
unanimously.
2020 Final Budget Adoption: Loso made a motion authorizing the Mayor and Administrator to execute
Resolution 2019-068 Adopting the Final 2019, Collectible in 2020 Tax Levy, and adopting the final 2020
Budget and Capital Improvement/Equipment Plans. The motion was seconded by Buckvold and passed
unanimously.
Ordinance Amendment – Ordinance 407 Street Light Utility: The amendment is consistent with the mediation
settlement that was agreed upon between the College of St. Benedict and the City.
Council consensus was to remove the word considered from the amended language.
Schultz made a motion approving Ordinance No. 2019-05 Amending Ordinance 407; seconded by
Theisen and passed unanimously.
Schultze made a motion approving Ordinance No. 2019-05 Summary Ordinance; seconded by Loso and
passed unanimously.

Zoning Ordinance 502 Amendments: Haffner highlighted the ordinance amendments. The majority of the
changes were formatting and general cleanup of the Ordinance. The major change would be to remove the
interim use permit process for residential rentals. Rentals would still be governed under the rental ordinance
and regulated through a permit process.
Theisen moved to approve Ordinance 2019-06 Amending Ordinance 502; seconded by Goracke and
passed unanimously.
Schultz moved to approve Ordinance 2019-06 Summary Ordinance; seconded by Theisen and passed
unanimously.
District 742 Space Request, Adult Basic Education: Ambuehl reached out to the Adult Basic Education
representative regarding questions the Council raised at the last meeting. Community Education does not
charge a fee for the class; just a minimal fee for the materials. They can use Kennedy Elementary in the
evening, but are unable to during the day. The request is to use the space for the remainder of the school year
and will reevaluate for the upcoming school year after summer session.
Buckvold believes the class is a benefit to the City and residents of the City.
Schultz asked if the building should have an attendant during the class hours. Ambuehl suggested having the
teachers get background checks. Schultz added he would feel most comfortable with the group using the space
during the day.
Buckvold made a motion to allow District 742, Adult Basic Education to use room 129 at the St. Joseph
Community Center for classes at no charge. The motion was seconded by Theisen.

Plowing of Field Street Trail: Thene noted there have been requests to plow trails throughout the City.
Currently staff plows the Klinefelter Park trail and the trail south to the school.
Buckvold would like to know what the demand is to plow trails in the City.
General consensus was to keep the plowing of trails and streets the same as what it currently is.
Engineer Reports, CSAH 133 Expansion Support Resolution: Sabart presented a resolution received from
Stearns County requesting the City’s support in the County’s request for federal funding for CSAH 133
expansion. The request would be for the 2024 cycle which allows the City and County to determine what
exactly the intersection improvements will be.
Schultz made a motion authorizing the Mayor and Administrator to execute Resolution 2019-069

Expansion from CSAH 75 to 15 Avenue in St. Joseph. The motion was seconded by Buckvold and
passed unanimously.
Department Head Reports, Administration: Ambuehl provided an overview of meetings he attended in the last
month. Upcoming meetings include meeting with the College and Metro Bus to review needs. The meeting with
CSB staff will be to improve communication and relations.
Department Head Reports, Community Development: Haffner reported that Sand Companies’ application for
tax credits to construct a 48 unit affordable housing apartment building in St. Joseph was approved. The Dollar

General Store is open. At the January 6 meeting the Council will review amendments to the rental ordinance.
Department Head Reports, Public Works: Thene reported staff has been working on snow removal and
equipment breakdowns due to the snow plowing. The ceiling at the city garage has been installed and insulated
and Precise is working on providing the heat source.

The Ice Bowl is January 11 and the proceeds go to the food shelf.
Department Head Reports, Police: Pfannenstein reported the City has been pretty quiet due to the students
being out and winter arriving.
Mayor Reports: No Reports.
Closed Meeting: Schultz made a motion to move into closed session at 6:58 PM pursuant to MN Statute
13D.05, Subd. 3(b) to discuss potential litigation. The motion was seconded by Loso and passed
unanimously.
The council came out of closed session at 7:13 PM.
Adjourn: Loso made a motion to adjourn at 7:13 PM; seconded by Theisen and passed
unanimously.
