Pursuant to due call and notice thereof, the Planning Commission for the City of St. Joseph met in regular
session on Monday, June 8t", 2020 at 6:00 PM at the St. Joseph Government Center.
Planning Commission Members Present: Commissioners, Brian Theisen, Chad Hausmann, Matt Johnson
Mike Ross, Anne Jarrell, Community Development Director Therese Haffner
Members Absent: Gina Dullinger, Steve Olson
Others Present: Planning Intern Josh Storms
Approval of the Agenda: Theisen made a motion to approve the agenda. The motion was seconded
by Johnson and passed unanimously.
Introductions: Introductions were made.
Approval of the Minutes; Johnson made a motion to approve the minutes of April 13" 2020. The
motion was seconded by Theisen and passed unanimously
New Business
a. Public Hearing, Ord 502 Amendment, Section 502.27 Rural Residential District
Haffner provided an overview of the proposed amendments to the RR Rural Residential District. The
ordinance was adopted in response to property in St. Joseph Township that was annexed into the City in
2018. Haffner explained that the intent of the amendment was to keep it consistent with Stearns County
regulations and recognizes that those areas are rural in nature. Haffner noted correction that kennels with
over 4 dogs would require a conditional use permit.
Hausmann opened the public hearing. As no one wished to speak, Hausmann closed the public hearing.
Hausmann asked if a litter of pups would require a conditional use permit. Haffner responded no.
Hausmann noted that animal feedlot expansions were a conditional use and asked if new animal feedlots
were addressed. Haffner said they were not and asked for direction. There was discussion on how
Stearns County addresses. Haffner indicated that prior to annexation the properties were zoned urban
expansion. Consensus was to keep it how it was governed prior to annexation.
Haffner discussed building construction and materials for detached accessory buildings and asked for
direction. There was discussion on requiring materials to match the house in residential subdivisions.
Jarrell asked if there was a limit to the number of buildings on the lot. Haffner discussed lot coverage and
setback requirements.
There was further discussion on building materials, height, and lot coverage. Consensus was to remove
restriction on accessory buildings shall not exceed the footprint of the principal building.
Johnson made a motion to approve Ord 502 Amendment, Section 502.27 Rural Residential
District. The motion was seconded by Jarrell and passed unanimously by those present.
b. Short Term Rentals Discussion
Storms gave a brief background on Short Term rental Properties (STPS) including their popularity,
nuisances affiliated with them and what types of STPs ordinances other cities have in place.
Haffner shared that last fall the city council directed city staff to research Airbnb's.
Ross asked if Short Term Residential Properties were properties in which people currently live in that they
rent out for a short period. Storms explained that the renter could be any homeowner in any residential

neighborhood that has applied for an STP application and filled out the necessary information required by
the company, allowing travelers to stay in their homes for a given amount of time.
Hausmann asked if currently anyone in the city could become a short-term rental property. Storms
responded that there was no specific langue about STP for St. Joseph, other than hotels and motels.
Haffner clarified that city ordinance was silent on short term rentals but city ordinance addresses a Bed
and Breakfast.
Johnson asked how this differs from an interim use permit from other residential rentals and what would
stop anyone that currently has an interim use permit for a rental property to change it to a STP. Haffner
clarified that short-term rentals would be short term, such as 30 days or less.
Hausmann asked what the current demand for short term rentals was. Haffner suggested that staff do
research on that.
The commission discussed the possibility of creating short term rental regulations with language similar to
traditional a Bed and Breakfast.
Jarrell asked if there were situations in which short term rental companies such as Vrbo and Airbnb would
pay the lodging tax. Storms stated that some cites have already done this, highlighting Duluth's 3%
lodging tax that was paid by Airbnb. Haffner clarified that there was a lodging tax in St. Joseph that
applies to all hotels, the Bed and Breakfast in town, and the College of Saint Benedict.
Consensus was for staff to research further and bring back findings.
Other Business
a. Council Liaison Report
Theisen reported on the City's efforts on implementing Clear Gov, an online budgeting tool to increase
transparency.
b. Other Member Discussion
Hausmann asked if there had been discussion on reduced revenue for businesses that are suffering due
to COVID 19 and are having trouble paying their property tax. Haffner stated that there were concerns,
including that Local government Aid could be reduced.
Adjourn: Johnson moved to adjourn the meeting at 7:12 PM. The motion was seconded by Theisen
and passed unanimously

STALL RECOMMENDATION: Approve Findings of a Fact and Interim Use Permit for a non -owner
occupied residential rental
PREVIOUS PLANNING COMMISSION ACTION:
BACKGROUND INFORMATION: Jon Petters, property owner, has requested approval of an interim
use permit to allow for a non -owner occupied residential rental in an existing single-family home located
on the southeast corner of College Ave N and Ash Street East, across the street from the Bad Habit
Brewery. The property is in a B-1 Central Business District, an identified down town commercial
redevelopment site and is currently vacant. A non -owner single family residential rental in an existing
single-family home is an interim use within the B-1 District for a maximum term of five years but may be
less as approved by the City Council after a review and recommendation by the Planning Commission.

RESOLUTION 2020-002
A RESOLUTION ADOPTING FINDINGS OF FACT AND APPROVING AN INTERIM
USE PERMIT FOR THE PURPOSES OF A NON -OWNER OCCUPIED RESIDENTIAL
RENTAL
WHEREAS, Jon Petters, hereinafter referred to as "Applicant," has properly applied for an
interim use permit for a non -owner occupied residential rental on the property generally described as 34
College Ave N. St. Joseph, MN ("Subject Property"); and
WHEREAS, the St. Joseph Planning Commission held a public hearing on the interim use permit on
July 13`h, 2020, at which time all persons wishing to be heard regarding the matter were given an opportunity
to be heard; and
NOW THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION OF THE
CITY OF ST. JOSEPH, MINNESOTA, hereby makes the following Findings of Fact:
1. That the Subject Property is zoned B-1, Central Business District and a non -owner occupied
single family residential rental is a permitted interim use.
2. That the interim use will not be detrimental to or endanger public health, safety, morals, comfort,
or general welfare of the neighborhood and will be harmonious to the to the objectives of the
Comprehensive Plan of the City.
3. That the residential rental will be located within the existing single family detached dwelling on
the Subject Property and is designed and constructed and will be operated and maintained so as to
be harmonious and appropriate in appearance with character of the area and will not be hazardous
or disturbing to existing or future neighboring uses.
4. That adequate utilities and services, including utilities, streets, drainage and other necessary
facilities have been provided and will not create excessive additional costs for services and/or be
detrimental to the economic welfare of the community.
5. That the interim use will not involve activities, processes, materials, equipment and conditions of
operation that will be detrimental to any persons, property, or general welfare because of
excessive production of traffic, noise, smoke, fumes, glare or odors.
6. That the existing access from Ash Street East provides access to the Subject Property which will
not create traffic congestion or interfere with traffic or surrounding public thoroughfares.
7. That the existing driveway will provide sufficient off-street parking and loading space to serve
the proposed use.
8. That the interim use will not result in the loss or damage of natural, scenic or historic feature and
the soil conditions are adequate to accommodate the use.

BE IT FURTHER RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF
ST. JOSEPH, MINNESOTA, as follows:
1. Based on the aforementioned Findings of Fact, the St. Joseph Planning Commission recommends
the St. Joseph City Council issue an interim use permit ("Permit") to allow a non -owner occupied
single family residential rental on the Subject Property.
2. The property owner shall obtain a rental license prior to renting and annually thereafter. Typical
rental permit and inspection fees will apply and be the responsibility of the property owner.
3. The property owner will manage the Subject Property in compliance with the St. Joseph Code of
Ordinances.
4. The residential rental on the Subject Property shall be limited to a family as defined within the St.
Joseph Code of Ordinances.
5. The dwelling shall be maintained as a single-family dwelling defined as a dwelling occupied by
one family and so designed and arranged as to provide cooking and kitchen accommodations and
sanitary facilities for one family only.
6. The property owner is responsible for meeting all Federal, State, Local, and City requirements
and obtaining any and all permits and licenses.
7. Revocation: The City Council shall revoke the interim use permit when it determines that the
terms and conditions of the permit as issued are no longer being complied with.
8. Expiration: The Permit shall expire within five years onJuly 13, 2025. If within one (1) year after
issuance of granting an interim use permit, the use permitted has not started, then the permit is
null and void, unless the City Council has approved a petition for an extension. The interim use
permit shall expire if the authorized use ceases for any reason for more than one (1) year.
9. The City Administrator and/or his/her designee shall have the right to inspect the premises for
compliance and safety purposes annually or at any time upon reasonable request.
Whereupon said resolution was declared duly passed and adopted by the St. Joseph Planning Commission
this 13`h day of July, 2020.

STALL RECOMMENDATION: Approve the Final Plat of Country Manor Senior Living Campus Plat
2
PREVIOUS PLANNING COMMISSION ACTION: The Planning Commission approved the plat and
Planned Unit Development (PUD) of Country Manor Senior Living Campus on June 13, 2016.
BACKGROUND INFORMATION: Country Manor St. Joseph LLC, owner, has requested approval of
a final plat to re -plat patio home lots within the Country Manor Senior Living Campus residential
development. The approved PUD provides for a senior facility and 95 patio home lots at full buildout.
The first phase included 12 patio homes lots that were final platted in which three have existing homes.
The proposed plat adjusts the boundaries of nine lots making the parcels larger and reducing the number
of lots to seven. According to the applicant, the purpose of the request is in response to the market and to
make the lots more useful and sellable. The applicant has also requested the vacation of drainage and
utility easements, which does not require action by the Planning Commission. New drainage and utility
easements of six feet along the interior boundaries are shown on the plat as required per the City's
Subdivision Ordinance.

REQUESTED PLANNING COMMISSION ACTION: Approve the Final Plat of Country Manor
Senior Living Campus Plat 2 contingent on the following conditions:
1. Vacation of the existing drainage and utility easement, along the interior side yard property
boundaries.
2. Submit revised grading plan for the house pad elevations.
3. The new proposed property boundaries will result in unused building services. The water service
curb stop boxes that will not be used shall be abandoned by lowering the curb box below grade
and the city will need to be provided with updated record drawings noting the abandoned service
locations.
4. Each lot is only allowed one curb cut access. Any existing curb cuts for driveway openings that
will result in extra, relocation, etc. will need to be replaced with full curb meeting city
specifications and boulevard areas shall be planted with vegetation i.e. grass.
