Planning Commission Members Present: Commissioners, Gina Dullinger, Matt Johnson, Steve Olson, Mike Ross, Brian Theisen, Community Development Director Therese Haffner Members Absent: Chad Hausmann, Anne Jarrell Others Present: Planning Intern Josh Storms Approval of the Agenda: Olson made a motion to approve the agenda. The motion was seconded by Johnson and passed unanimously. Approval of the Minutes; Johnson made a motion to approve the minutes of June 8, 2020. The motion was seconded by Ross and passed unanimously New Business a. Public Hearing, Interim Use Permit, Rental — 34 College Avenue North Storms recommended approval of an interim use permit for a non -owner residential rental in an existing single-family home. The property is located in a B-1 Central Business District, a downtown commercial redevelopment site. Dullinger opened the public hearing. As no one wished to speak, Dullinger closed the public hearing. Johnson asked if there was an interim use permit previously. Haffner said she found no record of an interim use permit. Dullinger asked if there was one house on the property and asked about the other structures. Jon Petters, applicant and property owner introduced himself and stated there was one house and detached garage on the property. Theisen made a motion to approve Resolution 2020-002 Adopting Findings of Fact approving an Interim Use Permit for a non -owner single family residential rental at 34 College Avenue North. The motion was seconded by Johnson and passed unanimously by those present. b. Final Plat, Country Manor Senior Living Campus Plat 2 Storms provided an overview of the planned unit development. The proposed final plat adjusts the lot sizes of nine lots reducing the number of lots to seven. Storms reported that the applicant requested vacation of drainage and utility easements which does not require action by the Planning Commission. Storms recommended approval of the final plat contingent on the following conditions: 1. Vacation of the existing drainage and utility easement, along the interior side yard property boundaries. 2. Submit revised grading plan for the house pad elevations. 3. The new proposed property boundaries will result in unused building services. The water service curb stop boxes that will not be used shall be abandoned by lowering the curb box below grade and the city will need to be provided with updated record drawings noting the abandoned service locations. 4. Each lot is only allowed one curb cut access. Any existing curb cuts for driveway openings that will result in extra, relocation, etc. will need to be replaced with full curb meeting city specifications and boulevard areas shall be planted with vegetation i.e. grass. There was discussion on the extra utilities. Ross asked the applicant if they would be able to sell all of the lots because Stearns Electric just added big transformer boxes. Scott Keho, Country Manor Campus/Continuum's Development Services LLC, applicant, introduced himself and clarified that he worked with Stearns Electric on relocation of their utilities. July 13, 2020 Page 2 of 2 Dullinger made a motion to approve the Final Plat of Country Manor Senior Living Campus 2. The motion was seconded by Johnson and passed unanimously by those present. Other Business a. Council Liaison Report Theisen reported a vendor event would be held behind the St. Joseph Government Center. The event will be held on August 1, 2020. Haffner reported that the City Council approved amendments to the Rural Residential District ordinance. b. Other Member Discussion Haffner requested to reschedule the November 9, 2020 regular Planning Commission meeting since there is a City Council meeting scheduled that evening. Consensus was to reschedule to November 10, 2020. Haffner shared that she received an inquiry from a resident to put in a second driveway on their property where they have a house and two detached garages. Haffner reported that the Planning Commission reviewed driveway accesses last year and the ordinance was amended at that time to allow a second driveway on corner lots. Haffner said she wanted to have an informal discussion with the Planning Commission. There was discussion on having perimeters on minimum lot width if allowed. JOSEPH MEETING DATE: September 14, 2020 AGENDA ITEM: Public hearings, Interim Use Permit Request s a. 110 College Ave N b. 13 Ash St. E SUBMITTED BY: Community Development STALL RECOMMENDATION: Approve Findings of a Fact and Interim Use Permits for a non - owner -occupied residential rental PREVIOUS PLANNING COMMISSION ACTION: On February 13, 2017, the Planning Commission approved interim use permits for the subject properties to allow for non -owner residential rental units for three years. BACKGROUND INFORMATION: Brandon Novak, owner is requesting interim use permits to allow for the continuation of non -owner -occupied residential rentals in the existing single-family homes at the properties addressed 110 College Ave. N & 13 Ash St. E. The properties are in a B-1 Central Business District and are currently rentals. The interim use permits have recently expired. The properties are identified commercial redevelopment areas. Existing single-family dwelling units in the B-1 District are allowed as an interim use for a maximum term of five years but may be less as approved by the City Council after a review and recommendation by the Planning Commission. The maximum density for rental units under the interim use permit shall be limited to the density which is allowed in the R-1, Single Family Residential District. JOSEPH PLANNING COMMISSION RESOLUTION 2020-003 A RESOLUTION ADOPTING FINDINGS OF FACT AND APPROVING AN INTERIM USE PERMIT FOR THE PURPOSES OF A NON -OWNER -OCCUPIED RESIDENTIAL RENTAL WHEREAS, Brandon Novak, Novak Rentals LLC, hereinafter referred to as "Applicant," has properly applied for an interim use permit for a non -owner -occupied residential rental on the property generally described as 110 College Ave N. St. Joseph, NIN ("Subject Property"); and WHEREAS, the St. Joseph Planning Commission held a public hearing on the interim use permit on September 14'x', 2020, at which time all persons wishing to be heard regarding the matter were given an opportunity to be heard; and NOW THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF ST. JOSEPH, MINNESOTA, hereby makes the following Findings of Fact: 1. That the Subject Property is zoned B-1, Central Business District and a non -owner -occupied single-family residential rental is a permitted interim use. 2. That the interim use will not be detrimental to or endanger public health, safety, morals, comfort, or general welfare of the neighborhood and will be harmonious to the to the objectives of the Comprehensive Plan of the City. 3. That the residential rental will be located within the existing single family detached dwelling on the Subject Property and is designed and constructed and will be operated and maintained so as to be harmonious and appropriate in appearance with character of the area and will not be hazardous or disturbing to existing or future neighboring uses. 4. That adequate utilities and services, including utilities, streets, drainage and other necessary facilities have been provided and will not create excessive additional costs for services and/or be detrimental to the economic welfare of the community. 5. That the interim use will not involve activities, processes, materials, equipment and conditions of operation that will be detrimental to any persons, property, or general welfare because of excessive production of traffic, noise, smoke, fumes, glare or odors. 6. That the existing access from College Avenue North provides access to the Subject Property which will not create traffic congestion or interfere with traffic or surrounding public thoroughfares. 7. That the existing driveway will provide sufficient off-street parking and loading space to serve the proposed use. 8. That the interim use will not result in the loss or damage of natural, scenic or historic feature and the soil conditions are adequate to accommodate the use. Based on the aforementioned Findings of Fact, the St. Joseph Planning Commission recommends the St. Joseph City Council issue an interim use permit ("Permit') to allow a non -owner -occupied single-family residential rental on the Subject Property. 2. The property owner shall obtain a rental license prior to renting and annually thereafter. Typical rental permit and inspection fees will apply and be the responsibility of the property owner. 3. The property owner will manage the Subject Property in compliance with the St. Joseph Code of Ordinances. 4. The residential rental on the Subject Property shall be limited to a family as defined within the St. Joseph Code of Ordinances. 5. The dwelling shall be maintained as a single-family dwelling defined as a dwelling occupied by one family and so designed and arranged as to provide cooking and kitchen accommodations and sanitary facilities for one family only. 6. The property owner is responsible for meeting all Federal, State, Local, and City requirements and obtaining any and all permits and licenses. 7. Revocation: The City Council shall revoke the interim use permit when it determines that the terms and conditions of the permit as issued are no longer being complied with. 8. Expiration: The Permit shall expire within five years on September 21, 2025. If within one (1) year after issuance of granting an interim use permit, the use permitted has not started, then the permit is null and void, unless the City Council has approved a petition for an extension. The interim use permit shall expire if the authorized use ceases for any reason for more than one (1) year. 9. The City Administrator and/or his/her designee shall have the right to inspect the premises for compliance and safety purposes annually or at any time upon reasonable request. JOSEPH MEETING DATE: September 14, 2020 AGENDA ITEM: Comprehensive Plan Compliance — Purchase of Property PID: 84.53794.0020 SUBMITTED BY: Community Development STAFF RECOMMENDATION: Approve Resolution finding the property purchase in compliance with the Comprehensive Plan. PREVIOUS PLANNING COMMISSION ACTION: BACKGROUND INFORMATION: MN State Statute requires the Planning Commission to review land transactions in relationship to their conformity with the City Comprehensive Plan. The City is considering the purchase of property adjacent to city owned parcels where the public works building is located. The parcel is approximately 1.61 acres and has two existing buildings on the property. The City has been planning to add a new public works building or add onto the existing public works building to accommodate storage needs. This purchase would allow the use of those existing buildings. The property is guided for Light Industrial according to the City Comprehensive Plan and zoned L -I Light Industrial District. The City owned properties to the south are guided for Light Industrial and zoned L -I Light Industrial as well. Warehousing is a permitted use in the L -I District which is consistent with the City's plan for storage with related uses. Access is off of 191}i Avenue NE. PLANNING COMMISSION RESOLUTION 2020-005 RESOLUTION FINDING THE PURCHASE OF REAL PROPERTY IN COMPLIANCE WITH COMPREHENSIVE PLAN LOT 14, BLOCK 1, RENNIE ADDITION WHEREAS, SMP Properties of St. Joseph, LLC, a Minnesota Limited Liability Company, hereinafter referred to as the "Owner" owns the real property legally described as Lot 14, Block 1 RENNIE ADDITION, Stearns County Minnesota ("property"); and WHEREAS, the City has an interest in the purchase of property to accommodate public works facility use as permitted in accordance with the City Comprehensive Plan and established zoning designation; and WHEREAS, the City Comprehensive Plan guides the property for Light Industrial to allow for storage use; and NOW THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF ST. JOSEPH, STEARNS COUNTY, STATE OF MINNESOTA: That purchase of the property is consistent and in compliance with the City Comprehensive Plan.
