Conference.

FISCAL IMP ACT: The following is a breakdown of the estimated cost to attend the IACP Conference.
Room: $870.00, Air: $370.00, Registration: $220.00, Total approx. $1460.00. This does not include
meals.
COMMENTS/RECOMMENDATIONS: The International Police Chiefs Conference is held once a year
somewhere in the United States. People from all over the United States and the world come for excellent
training and networking. Areas of education this year will range from leadership training to Homeland
Security to the latest in technology and how to use it. There will he exhibiters showing the latest in
equipment and computer software. There is also time to network with other chiefs. This I find is at time
the most important part of the conference. It gives me time to exchange ideas with other chiefs who have
had or are dealing with the same problems I do.
When taking this position, the Council agreed to allow me to attend this conference every other year
budget permitting. This will be the first conference that I have requested to attend. I did budget for this
in 2005.

I. Contractor shall confine construction operations to the
construction limits shown.
2. All work shall conform to the Minnesota Pollution Control
Agency's Storm Water Permit requirements. Contractor shall
obtain NDPS permit and comply with all Permit requirements.

and within 24 hours of any measurable rainstorm. Damaged

The following comments are in response to a review by City Staff dated 2 Jun 05:
General Zoning Comments
1. The County was contacted regarding setback requirements along County Road 133. There are none.
However, the proposed screened chain link fence location has been offset 18 feet from the right of way line
to better accommodate clear zone requirements should future traffic volumes warrant.
2. Off street parking availability exceeds ordinance requirements.

3. Loading berth accommodations exceed ordinance requirements.
4. The initial submittal indicated a north-south dimension of the existing building of280.4 feet based on field
survey. We are not certain how the 254.9 value in the review comments was derived. Mr. Hettwer has
presented a correct tabulation of area values to the Planning Commission.
5. The lock box issue is to be addressed by the Owner..
6. Landscaping features have been added to the plan based on the Planning Commission discussions.
7. The southwest parking lot has been re-designed to comply with setback requirements.
8. The north parking area has been re-designed to comply with setback requirements.
9. The dry well is to be removed.
10. The 0 wner has submitted sign details to the City.

2. Concrete curb & gutter has been added to the plan. A drafting error indicated the north entrance to be
wider than the 36 foot maximum on the initial submittal. This has been corrected.

4. There will be no significant increase in runoff to the downstream storm system resulting from this project.

to be temporary.

Northland Heights - Preliminary Plat
PREVIOUS ACTION
The Planning Commission considered the Preliminary Plat for Northland Heights on May 16, 2005. At
that hearing the Planning Commission concurred with staff that access from Northland Heights to CR 133
is in the best interest of public safety. The proposed housing development contains 154 single family
homes, generating approximately 1600 trips per day. The intersection at Northland Drive cannot
accommodate the additional traffic and both the City and County Engineer have identified that access to
CR 133 is crucial. The Council Engineer has requested that the connection to CR 133 be constructed with
phase one. The City agrees the access is needed but would agree that the connection does not need to be
completed until one of the later phases. The matter was tabled at this meeting and a recommendation was
forwarded to the Council to consider utilization of the eminent domain proceedings for the ROW if an
agreement could not be reached with the affected property owners.
On June 2,2005 the City Council passed resolution 2005-14 authorizing eminent domain for the ROW if
an agreement cannot be reached with the property owners. Ted Schmid was also required to execute an
agreement whereby he would pay all costs for the ROW acquisition. This agreement has been executed.
On June 6, 2005 the Planning Commission re-considered the Preliminary Plat and recommended the
Council approve the plat with conditions. That motion is included in following this page and has been
prepared by Tom Jovanovich.
RECOMMENDED COUNCIL ACTION

COMMENTS/RECOMMENDATIONS
The Planning Commission finds that the Northland Heights plat does not have access to a collector or
arterial street. The plat when fully developed will create 154 residential homes, which will have to obtain .
ingress and egress from the plat through existing residential neighborhoods. The Planning Commission
finds'that this amount of vehicle traffic in an existing residential area will create public safety issues.
Accordingly, the preliminary plat is approved with the following conditions to insure that the Developer
provides appropriate access to an arterial road by September 30, 2008. Without these conditions the plat
would not be approved."
Minnesota law allows for approval of plats with conditions as part of the approval. MN ST 462.358, Subd.
3b requires y that the conditions of preliminary plat approval be "express". The developer may proceed
once the conditions are met through performance or by executing agreements assuring performance of
the conditions.
The preliminary plat of Northland Heights is hereby approved subject to the following conditions:
(1) The City obtains the necessary right of way to allow access from the platted property to
County Road 133 at the Developer's expense.
(2) The Developer shall construct or pay the costs of construction of the road and the
underground utilities to County Road 133.
(3) The Developer may proceed with final platting of Phase 1 of the development if it enters
into a written agreement satisfactory to the City which shall assure the Developer's
performance of conditions 1 and 2. Phase 1 consists of Block 1, Lots 1-6, Block 2, Lots
1-28, Block 3, Lots 1-30, Block 4, Lots 1-16, Block 5, Lots 1-3 and Block 6, Lots 1-5.

The Developer may not proceed with final platting of Phase 2 of the development
consisting of Block 2, Lots 29-36, Block 5, Lots 4-16, Bock 6, Lots 6-27, Block 7, Lots 1-9,
Block 8, Lots 1-13, and Block 9, Lots 1-5, until such time as conditions 1 and 2 are met.

AGREEMENT
This Agreement is entered into this 24 day of May, 2005, by and between the
City of St. Joseph, a Minnesota municipal corporation (hereinafter the "City"), and Lumber
One Development Company, LLC., a Minnesota limited liability company (hereinafter
"Lumber One").
Recitals:
1. Lumber One has submitted a preliminary plat for approval by the City for a
residential development known as Northland Heights ("Development").
2. The City has determined that because of the number of homes proposed in the
Development, right of way access from the Development to County Road 133 will be
required to alleviate traffic safety issues on Northland Drive.
3. The property encompassed by the Development is not adjacent to County Road 133.
Additional land is required.
4. The City is willing to obtain the property necessary for the right of way by exercise
of eminent domain.
S. Lumber One is willing to pay for all costs associated with obtaining the right of way
property.
NOW, THEREFORE, in consideration of the mutual covenants expressed herein, IT IS
HEREBY AGREED AS FOLLOWS:
1. The City shall determine the legal description for the necessary right of way acquisition and
shall negotiate the purchase with the affected property owner(s). In the event that a negotiated
purchase agreement cannot be reached, the City shall proceed with acquisition of the property by
eminent domain. It is estimated that one acre( s) of property will be needed for the right of way.
2. Lumber One shall pay all costs, including but not limited. to survey costs, the acquisition
price or condemnation award, legal fees and costs, and recording fees, relative to the acquisition
of the right of way needed to provide access from the Development to County Road 133.
3. Lumber One shall deposit with the City a cash escrow or letter of credit in the amount of
$ 0.00 as security for the costs of the acquisition. The City shall provide Lumber One
with invoices on a monthly basis. Lumber One shall pay the invoices within 15 days of receipt.
In the event that Lumber One does not timely pay the invoices, the City may draw down the
security to pay such invoices.
4. Lumber One agrees that the acquisition of the right of way is reasonable and necessary due
to the number of residences proposed in the Development and the resulting impact they will have
on Northland Drive.
5. Assignment. This Agreement may not be assigned by Lumber One except upon obtaining
the express written consent of the City.
6. This Agreement may not be amended, changed, or modified without the express, written
consent of the parties hereto.

7. Governed by Minnesota Law. This Agreement shall be interpreted under the laws of the
State of Minnesota.
8. Representation. Rajkowski Hansmeier Ltd. represents the City with regard to this
Agreement. Lumber One is hereby advised to seek independent legal advice prior to execution
of this Agreement.
The parties have entered into this Agreement effective as of the date first written above.

1.0 Scope
This report covers the proposed grading, storm sewer, street construction,
sanitary sewer and water main improvements for the 2005 Northland Heights
Improvements in St. Joseph, MN. A project location map (Figure 1) is
included in the Appendix. Construction of the improvements is proposed for
late summer of 2005.
2.0 Feasibility
Having investigated the facts related to construction of the proposed
improvements, it is my opinion, from an engineering standpoint, that this
project is feasible, cost effective and necessary.
3.0 Background
Lumber One Development IS the OwnerlDeveloper of the proposed
Northland Heights Phase 1 Improvements. These improvements are to
consist of the first phase of a proposed two-phase build out of the Northland
Heights Preliminary Plat (Figure 2). The first phase will consist of
approximately 88 lots.
4.0 Existing Conditions
The historic use of the property is agricultural. Prior to construction, the
Developer will completely remove the existing turkey barns, any
underground foundations and accessory structures located throughout the
first phase of proposed improvements. According to the Developer, there are
no known underground tanks or any soil contaminations, and as such, is not
covered in this report. There is not any demolition of existing structures
covered in the scope of this project.
The property is bordered by agricultural land to the north and west, with
wooded parcels to the south and east. There is a large portion of wetland that
runs through the property and ultimately connects and drains to a larger
wetland located to the south of the proposed plat.

5.0 Proposed Improvements
5.1 Sanitary Sewer Collection System
An 8..,inch PVC gravity sanitary sewer (Figure 3) will serve all lots within the
proposed subdivision. The proposed gravity sewer will connect to an existing
sanitary sewer stub located on Iris Lane (Northland Plat 6), which ultimately
feeds to the lift station located on Northland Drive in the northeast comer of
Northland Park. A 4-inch PVC sanitary sewer service will be provided to all
lots.
Sanitary sewer will be constructed within the public street's right-of-way,
with the exception of a stretch of sewer located within a drainage and utility
easement that runs between Iris Lane and Hawthorne Loop. Sanitary sewer
will be stubbed out for future phases.
5.2 Water Supply
Proposed water main improvements (Figure 3) will consist of 8-inch ductile
iron water main. The water main will connect to the existing 8-inch stub(s)
located on Jasmine Lane (Northland Plat 8) and Iris Lane (Northland Plat 6).
The Developer will be required to obtain easements along the proposed
Jasmine Lane between the existing Northland Plat 8 and the proposed
Northland Heights Phase 1 in order to install water main through this area
and loop into existing utilities. Fire Hydrants will be located approximately
500 feet apart for fIre protection and flushing purposes. One inch copper
water service will be provided to all lots.
5.3 Streets, Grading and Drainage
Proposed street improvements (Figure 4) consist of 36-foot wide streets on
Jasmine Lane, Iris Lane, 13th Avenue and 14th Avenue. Iris Lane will connect
to the existing Iris Lane which was constructed as part of the 2002 Northland
Plat Six Improvements. The cul-de-sac, which services the east end of
Northland Plat Six, will be removed and extended into the Northland Heights
Development. Jasmine Lane will not be connected as a through street as a
part of phase one, it will terminate at the west edge of phase one and will be
extended at a later date. According to preliminary plat approvals, the street
connection of Jasmine Lane to the existing Jasmine Lane in Northland Plat 8
will be constructed on or before the year 2008. The proposed pavement
cross-section for these roadways consist of a 1.5-inch bituminous wear
course, 2-inch bituminous non-wear course, 6-inches of Class V aggregate
base and 18-inches of select granular borrow with geotextile fIlter fabric and
draintile. The 18 inches of select granular borrow, geotextile fabric and drain
tile will be used on sections of roadway where the existing roadway material
is unsuitable for typical road construction. Concrete sidewalks, 6-feet wide
arid 4-inches thick (6 inches thick at driveways), will be constructed along
the south side of Iris' Lane which connect to existing sidewalk located on
Northland Drive. A walkway path is also proposed to be located along lot
lines between Iris Lane and future Hawthorne Loop. B618 concrete curb and
gutter will be used throughout the development.
Drainage will be accomplished through the use of curb and gutter and a
storm sewer system (Figure 3). Runoff from the development and from
adjacent properties abutting the plat will be collected by catch basins located

throughout the development. The storm sewer system will carry storm water
to the storm water ponds for treatment.
The Developer will be required to obtain easements on the proposed phase 2
portion of the site. Grading operations will be required on phase 2 in order to
construct the grading improvement on phase 1.
6.0 Right-of-Way
All streets within the development will be generally centered within a 66-foot
street right-of-way. Drainage and utility easements at least to-feet in width
will be dedicated along public street right-of-way and at a minimum to-feet
along lot lines where ever water main, sanitary sewer and storm sewer will
be constructed. Drainage and utility easements along all other side and rear
lot lines will be at least 5 feet in width. Storm water ponds will be located on
outlots which will be dedicated to the City so they may be accessed and
maintained by the City.
7.0 Cost Summary
The costs presented below are the engineer's estimate in 2005 construction
dollar.

8.0 Estimates
Lumber One Development, LLC has requested that the internal municipal
improvements associated with Northland Heights be constructed as a fully
assessed City project according to Minnesota Statues Chapter 429.
The full cost of the project, including construction costs, engineering and
legal and fmancial fees are to be assessed back to the Development. The total
cost is divided up so the cost is assessed equally to the 88 lots. An additional
$600/Lot will also be added to cover the lift station costs from the Northland
Plat 5 Development.

8.1 Alternate 1
An alternate to be considered for the street widths on Jasmine Lane, 13th and
14th Avenues from 36-feet wide to 32-feet wide would drop the overall
project cost from $2,612,438 to $2,569,882.
This alternate to street widths would save approximately $500/lot. The total
assessments per lot with the alternate street widths would be $29,803.

Richard Schroeder - Preliminary and Final Plat, Walz's Hillside Acres Plat 2
PREVIOUS ACTION
During the Council discussion of the Hill Street Utility Improvement, Rick Schroeder discussed the
possible lot split of his property to allow for a second home to be built. Since Schroeder has enough
property to create two conforming lots, the improvement project was designed to accommodate a second
home. Under the Ordinance property can be split once without platting, but only if the property is platted
to begin with. Since Schroeder's property was not platted his required to complete the platting process.
The Planning Commission conducted the required public hearing and recommended the Council approve
the final and preliminary plat for Walz's Hilltop Acres Plat 2.
RECOMMENDED PLANNING COMMISSION ACTION
Accept the recommendation of the Planning Commission and approve the preliminary and final plat as
presented.
COMMENTS/RECOMMENDA TIONS
Since this plat was prepared with the assistance ofthe City Engineer, the plat is complete and there are
not outstanding issues. The plat has been reviewed by the Department Heads without comment.

Honorable Mayor and Member of the City Council:
I would like to propose a Hydrant Replacement or Hydrant Upgrade Program.
The reason for the program is that there are a few hydrants that date back to
1949-1959 and are not scheduled for replacement or future updates. Most of
these hydrants aren't the traffic breakaway type and have a 4" pumper nozzle. A
standard hydrant has a 4%" pumper nozzle and a 2-2%" nozzle. Estimated cost
of the program is $30-35,000. I would suggest that the program be completed
within 3-5 years.

The City had a lease with Cellular 2000, leasing space on the tower for antennas and ground space for the
required cabinets.
RECOMMENDED COUNCIL ACTION
Accept the request of Verizon to relocate the existing cabinets near the water storage facility authorizing
the Mayor and Administrator to execute a lease agreement. The location of the shelter will be determined
by the City Engineer and Public Works Director

Verizon has since assumed the lease from Cellular 2000 and is requesting to remove the existing
equipment, located new equipment and house such in a structure. The City is bound to the existing lease
and placing the cabinets in a structure certainly makes more sense. Originally their request included
addition land and we informed Verizon that with the W obegon Center we do not wish to lose any
additional land. If they are allowed to replace the existing equipment, the land space by using an
enclosure will actually be smaller. I will forward by email colored photos of the proposed shelters. As
you can see from the email they have agreed to increase the monthly lease payment and build a stick
structure if we so chose.

Dear Judy,
Thankyou for taking the time to meet with me this morning. Following our meeting I had my
weekly conference call with Verizon, and they were extremely disappointed that we had "taken a step
backwards" and no longer have a clear idea of where the shelter is to be located. Although I don't
completely agree with that assessment, since the lease assumption March 1 st I have not gotten the City
to progress on any of the issues that stand in the way of the removal and replacement of the existing
equipment.
In hopes of spurring significant progress, I have been authorized by Verizon to up the rent to
$1,000.00 per month (nearly double the current rent). This increase is being offered only if the
installation portion of the project can be transmitting by the end of July. This would require City
approval in the next 3 weeks. In addition, Verizon is willing to build a "park-like" shelter with a peaked
roof and exterior facade rather than use one ofthe pre-fab shelters we have been discussing (this is
considerably more costly). I am hoping that these incentives not only meet the Cities desire maintain
the visual aspects of the area at the base of the tower, but that the additional income can also help fund
some of the other projects you mentioned - such as the parking lot.
Please contact me at your earliest opportunity to let me know a realistic time frame in the City's eyes'
to project for the installation. Thank you.

There have been several exciting developments on the Northstar Commuter Rail project over the past several
months, leading to significant progress toward making Northstar a reality. I would like to provide you with an
update on the project.
State Approves First Step of Funding for Northstar Commuter Rail
With overwhelming support from legislators from all parties and areas of the state, the 2005 Legislature voted in
favor of state funding for Northstar Commuter Rail. On April 11, Governor Pawlenty signed into law the $886
million bonding bill that includes $37.5 million for Northstar Commuter Rail. This is the first time significant state
funding for Northstar has been approved by the Minnesota Legislature.
Passage of the bonding bill this year was vital to the future of Northstar Commuter Rail. The previous lack of
state funding jeopardized the project's standing with the Federal Transit Administration (FTA) and delayed
important progress on the project. The strong support from legislative leaders and the Governor sends a clear
signal to the FT A that Minnesota is committed to Northstar and is worthy of a federal investment in the project.
Next Steps
The coming months will be busy as the Northstar Corridor Development Authority (NCDA) and the Minnesota
Department of Transportation continue work on the project. The state funding allows for significant project
advancements including:
· Application to the FTA for final design approval, regaining a "Recommended" rating and accessing highly
competitive federal matching funds.
· Proceeding with major engineering, design and property acquisition.
· Continuing negotiations on construction and operating agreements with BNSF Railway Company.
We anticipate making steady progress as we head into the 2006 legislative session. The NCDA and other project
backers will be seeking the final state commitment needed to complete construction on Northstar, which is
currently estimated to be $51 million in bonding. This state funding is in addition to the $44.2 million committed
locally by the NCDA and the anticipated federal match of $132.5 million.
While there is more to be done before Northstar is operational, the overwhelming support for Northstar this year is
a positive sign for the future. We are pleased to see the project moving forward and are optimistic about gaining
the remaining state and federal funding that will get Northstar up and running to deliver relief to Minnesota
commuters.

Please find enclosed a copy of Judge Pearson's Order in the unlawful detainer action entitled
Rock Investments v. Hanke, et al. There are a number of mistakes in this Order that I brought to
the Court's attention in the attached letter and hope to have corrected. The most obvious
mistakes are that the City of St. Joseph was not a party to the unlawful detainer action and Kevin
Carpenter did not represent the City of St. Joseph.
In essence, the Court denied the landlord's request to evict the tenants and held that the landlord
should have appealed or requested reconsideration of the Court's decision in the first eviction
action, rather than bring a second eviction action. Although the landlord lost the unlawful
detainer action, I believe the landlord's attorneys made good faith efforts in attempting to evict
the tenants.
We are still a party to the complaint for declaratory and injunctive relief entitled Carpenter v.
City of St. Joseph, et aI., Court File No. C3-05-1445. Attorney Carpenter brought this action
seeking an injunction alleging that St. Joseph's noise ordinance was unconstitutional. The Court
did not address the constitutionality of St. Joseph's noise ordinance in the unlawful detainer
action.
Since the Court issued its decision in the underlying unlawful detainer action, most of the issues
in our case have been rendered moot. I spoke with Attorney Carpenter and am working to have
him voluntarily dismiss this case against us. If he will not dismiss us from this action, I will
bring a motion seeking dismissal of the case. I will keep you posted of any developments in this
case.

2. The plaintiff did not present any evidence that noise could be heard "outside the limits of
the real estate..." The officer testifioo he could hear noise in the parking lot... Although
there was a noise complaint made to the police, no complairiant testified.
CONCLUSIONS OF LAW
1. This court does not know if the February rent was paid before or after FebIilary 20, 2005.
If it was paid before February 20, 2005 this court questions how acceptance of rental
payment before the act complained of could be considf..-rOO a waive,[". However, based on
~s same incident, the District Court has already ruled that a waiver occurred. Th~ if
pL1intiff 5 acceptance for rent is a waiver of a noise violation, it is also, as a matter of
law, a waiver of any other violation that occurred at the same time, including, but not
limited to, permitting a mino.r to consume alcoholic beverages. Additionally, even if the
consumption by the minor occurred on a different date. the issue needed to be raised in
C7-05-816, if the incident occurred before plaintiff began the eviction proceedings.
2. ~suming the rent was paid before February 20, 2005, the proper procedure was to
appeal or request reconsideration pursmmt to the Minnesota Rules of Civil Procedure. If
the court's Order on March 10, 2005 should have been titled as a judgment ~ appellate
purposes, the court could have previously addressed that issue jn response to a letter for
reconsideration and made any adjustments necessary to appeal that ruling.
3. Although the noise violation was not proven, plaintiff did show there were minors on the
premises consuming alcohol. However, no further ruling on that issue is necessary
because it had to be raised at the eviction action in file C7-05-816.

Dear Mr. Breth:
The purpose of this letter is to respond to your complaints regarding your driveway improvements that
were constructed with the County Road 121 Project. You will need to discuss this with Stearns County
Highway Department since the County Road 121' Street Improvement Project was designed, inspected,
and administered by Stearns County Highway Department. The portion of the project that was designed
by the City's engineer was the water and sewer improvements. The City has passed on your complaint to
the County and they will be contacting you to discuss your complaints.
I would like to note that during this construction season there is additional storm water draining into the
gutter on County Road 121 due to construction on Iverson Street. Storm water runoff from Iverson Street
drains into catch basins along that street. However, since the final lift of pavement has not been installed,
some of the storm water runoff is not able to enter the catch basin and runs into the County Road 121
gutter. This additional runoff from Iverson Street will be eliminated once Iverson Street final lift of
pavement is installed after this construction season.

The Coalition of Greater
Minnesota Cities lobbied on
multiple fronts in the
Legislature this year in an
effort to restore lost funding
for Local Government Aid, fmd
money for economic develop-
ment, produce a balanced
transportation program, pro-
tect the state's water inventory
and defend the annexation
rights of our cities.
Our efforts met with varying degrees of success. We
won on some issues and lost on others. Still other issues will
be addressed by the Legislature during its special session.
When the 2005 Legislature convened in January, leg-
islators talked openly of bipartisan cooperation. The coalition
sought to foster that bipartisanship among rural House mem-
bers. Working with Reps. Dan Dorman, R-
Albert Lea, and Paul Marquart, DFL-
Dilworth, we helped organize an informal
working group of rural House Democrats
and Republicans. We believed that a rural
coalition of legislators working together to
resolve common issues would have a pro-
found impact on the day-to-day dynamics of
the Minnesota House.
The experiment was only modestly
successful. We were able to present our
ideas to. a large number of Republicans and
Democrats, and they, in turn, discussed them at length. But on
the floor of the House, bipartisan cooperation frequently gave
way to caucus politics.
When Marquart sought to close corporate tax loop-
holes and use the revenue to increase LGA funding by $66 mil-
lion, the amendment failed on a 67-67 tie. The House DFL and
Dorman supported the amendment. Other rural Republicans -
some of whom had privately expressed support for the LGA
proposal- sided with their caucus leaders and voted against the
property tax relief amendment.
House Republicans, instead, produced a tax bill that
cuts Local Government Aid funding by $17.5 million. While
the House tax bill offers increased LGA funding to some
greater Minnesota cities, it does so by undercutting the pro-
gram's long-term viability. The bill cuts $27.5 million from the
LGA allocations for Minneapolis, St. Paul and Duluth and
gives $10 million from the savings to other cities in the pro-
gram.
Clearly, the House strategy is designed to weaken the
consortium of cities that receive tax equalization assistance. In
a letter to all House legislators, the coalition characterized the
LGA provision as a step towards dismantling the program.
In the Senate, meanwhile, the CGMC successfully
promoted formula changes and $86 million in new funding for
Local Government Aid. With assistance from many of Qt.
members, we made a strong case for the new funding and for
making the aid distribution formula more responsive to the
needs of our cities.
On transportation funding, we fought
for increasing the gas tax by as much as 10
cents a gallon and increasing the license tab
fees. Like many transportation advocates,
we were convinced that Minnesota was
falling $1 billion a year short of meeting its
transportation needs.
We insisted, however, that a constitu-
tional amendment not be used as a mecha-
nism to increase the gas tax, funding contin-
ue to be split evenly between projects in rural
Minnesota and the Twin Cities metropolitan
area, and existing sales tax revenue not be dedicated to funding
transit.
The coalition opposed the House transportation bill
because it dedicated a quarter percent of sales tax raised in the
Twin Cities to transit. We argued that use of existing sales tax
revenue for transit would create a hole in the general fund that
would have to be filled with highway revenue. Moreover, it
would have created a two-tier general sales tax in Minneso..
6.5 percent for greater Minnesota taxpayers, and 6.25 perce
for taxpayers in the Twin Cities. (continued on page 2)

. While many rural Republicans
'rted our position, many rural
Democrats opposed it. One rural
Democrat angrily accused us of siding
with the MinnesotaTaxpayers League and
Republicans, saying, "I wish the CGMC
would have sided with us rather than the
Minnesota Chamber, the Taxpayers League
and the Grand 01' Party."
The transportation bill passed
both the House and Senate. Even though
Gov. Tim Pawlenty eventually vetoed the
bill, a little-known provision - a proposed
constitutional amendment - survived.
The amendment calls for com-
pletetransfer of the Motor Vehicle Sales
Tax from the general fund to transporta-
tion funding. According to the amend-
ment, "no less than" 40 percent of the
sales tax proceeds can be used for transit,
and "no more than" 60 percent of the
revenue can be used for highways. If
voters approve the amendment, transit
programs theoretically could receive all
of the sales tax proceeds.
Rural House Republicans and
Democrats did work cooperatively for
rural economic development during the
regular legislative session. As a result,
the coalition made significant strides in
securing economic development funding
for greater Minnesota. In the final
House-Senate bonding bill, we received
$10 million for a business infrastructure
matching grants program and $7.5 mil-
lion for a rural redevelopment program.
With assistance from many of
our members, the League of Minnesota
Cities and the Minnesota Association of
Small Cities, we successfully fended off
township efforts to weaken the state's
annexation law. When township lobby-
ists pressed the House Local
Government Committee to approve an
annexation moratorium, the committee
simply tabled the issue.
By working together, we have
made our voices heard on Local
Government Aid, annexation, economic
development, environment and trans-
portation. While some of those issues
still must be resolved in a special legis la-
tive session, legislators - Democrats and
Republicans - know where we stand on
issues critical to greater Minnesota.

Despite Mediation, Townships Introduce Bills
After failed mediation sessions
between city and township lobbyists
and the resolution of two large annexa-
.~, townships put considerable pres-
" on the Legislature last session to
pass legislation restricting a city's right
to grow.
While the Senate Local
Government Committee, chaired by
Sen. Linda Higgins, DFL-Minneapolis,
only held one informational hearing on
the issue, annexation was a hot topic in
the House Local Government
The House Local Government
Committee heard all of the bills. After
a strong, joint lobbying effort by the
coalition, the League of Minnesota
Cities and the Minnesota Association
of Small Cities, the committee tabled
all of the annexation issues.
Olson, interested in brokering
a deal between city and township
groups, is considering holding interim
annexation meetings this 'summer in
various cities across the state.

Greater Minnesota, which revealed
that the current annexation laws
impede growth and development in
cities and contribute to environmental
degradation.
Several township-sponsored
bills were introduced late in the legisla-
tive session. The coalition responded
by introducing two of its own bills.
2005 Bills Addressing Annexation and Land Use Issues:
HF 1971 (Nelson, P., R-Lindstrom)/S.F. 1867 (Tomassoni, DFL-Chisholm):
"Alternative local government annexation process provided." CGMC opposed,
HF 2443 (Nelson, P., R-Lindstrom):
Repeals current annexation-by-ordinance procedures and contested case process;
creates an "alternative annexation process." CGMC opposed.
HF 2437 (Anderson, B., R-Buffalo Township):
Places a one-year moratorium on any contested annexation outside the metro area
and any property-owner petitioned annexation. CGMC opposed.
HF 2060 (Liebling, DFL-Rochester):
Would create a land use advisory council to monitor the state's annexation issues,
repeal 60 acre limit on property-owner petitioned annexations, and streamline the
annexation process for land that is clearly urban or suburban or about to become so.
CGMC supported.
HF 2061 (Lanning, R-Moorhead):
Would limit development in townships and would allow city land use regulations to
extend up to two miles outside city limits. CGMC supported.
Property Tax Relief Unresolved in State Budget
The 2005 legislative session
ended with the House and Senate,
Republicans and Democrats miles
apart on taxes, the state budget and
Local Government Aid funding~
When the session convened in
January, the Coalition of Greater
Minnesota Cities had a simple goal:
restore $60 million of the $150 million
that was cut from the property tax
relief program in 2003.
By May 23 when the regular
legislative session ended, only the
Senate had earmarked $86 million to
increase funding for LGA. In contrast,
the House tax bill cut $17.5 million
from the city aid program. As a result,
House and Senate negotiators must
find a compromise during the special
legislative session that bridges the
$100 million difference.
The coalition proposed and
had hearings on the One Minnesota
Act in both the House and Senate tax
committees during the regular legisla-
tive session.
The legislation - authored by
Rep. Greg Davids, R-Preston, and Sen.
Tom Bakk, DFL-Cook, and sponsored
by over twenty other legislators -
would have increased funding for
LGA, education and transit. A portion
of the statewide Motor Vehicle Sales
Tax that is now used to fund local tran-
sit programs would have been returned
to the general fund to fund two
statewide programs, LGA and schools.
The legislation would have increased
metro transit funding $60 million a
year by authorizing a half-cent region-
al sales tax, a growing revenue source
that is more stable than the sales tax on
cars and trucks.
While the bill was positively
received by the Minneapolis Star
Tribune and the news media in greater
Minnesota, it encountered consider-
able resistance from some suburban
and urban legislators. They main-
tained that the state must continue to
rely on the Motor Vehicle Sales Tax
for transit funding.
House Democrats did show
strong support for LGA funding, how-
ever, by unanimously supporting a tax
bill amendment offered by Rep. Paul
Marquart, DFL-Dilworth. Marquart
sought to close corporate tax loopholes
to generate a $66 million funding
increase for LGA. .

The House cut $27.5 million
from the LGA that. Minneapolis, St.

exchange, the three first-class cities
were to be given authority to use a
local option sales tax to fund their
government operations.
If passed into law, the House
plan would further divide cities and
lessen support for LGA and cities.
The coalition strongly opposed the

Cities Targeted to Pay for Water Clean-Up
Clean Water Legacy account, and a
council would be created to advise the
governor on how to spend the money.
While the Coalition of Greater
Minnesota Cities supports the overall
goal of water protection, the coalition
believes that the process used to devel-
op TMDLs must be fair, open and
based on good science. Moreover, state
funds should be made available to help
cities meet the new environmental
mandates.
The CGMC opposed the Clean
Water Legacy Act because the legisla-
tion failed to address the coalition's
three primary concerns:
Grants, not loans. The
CGMC argued that funding for com-
pliance of TMDLs should be in the
form of grants, not loans, so that cities
would get actual relief from unfunded
mandates. As a result of the CGMC's
efforts, a TMDL matching grant pro-
gram was added to the legislation,
although it received no funding.
No, unfair fees. The CGMC
maintained that the fees imposed by
the Clean Water Legacy Act were
regressive taxes, not user fees. The
CGMC supported proposals that would
have funded clean water activities with
appropriations from the general fund.
No third party TMDLs. The
CGMC was very concerned about pro-
visions in the bill that would allow any
public or private entity to develop a
TMDL. The CGMC argued that pri-
vate, special-interest groups - groups
that may be influenced by a political
agenda rather than good science -
should not be allowed to write the
mandates that will be imposed on
cities.
As a result of the CGMC's
efforts, some improvements were
made to both the House and Senate
versions of the bill. In spite of the
progress, the CGMC's concerns have
not been adequately addressed and the
coalition remains opposed to the bilL

When the Senate passed the
Clean Water Legacy Act late in the reg-
.' ar session, lawmakers also voted to
pose new total maximum daily load
(TMDL) mandates on cities that could
cost them millions of dollars in waste-
water treatment upgrades and could
stall economic development in many
cities.
The House adjourned without
bringing the environmental legislation
to 'the floor, but the bill still could be
part of the Legislature's special-session
agenda.
The bill's aim is to clean up
Minnesota's water by imposing new
TMDL standards (the level of pollu-
tion a body of water can accommodate
without suffering environmental dam-
age) on wastewater discharges.
Proponents of the bill maintain that the
legislation authored by Rep. Dennis

CGMC Fights for Fair Education Funding
Education was a hot topic in
the beginning days of the session, with
the House increasing its funding level
above the governor's and the Senate
topping both of them.
In January, the Coalition of
Greater Minnesota Cities proposed
increasing school funding by at least
three percent a year for the next two
years. The coalition argued that K-12
education - its funding sharply cut in
2003 to help balance the state's budget
- was entitled to a genuine increase in
state support, rather than a funding
increase created by shifting money
from one program or region to another.

The coalition opposes legislation that
aggravates the disparities that already
exist in school property taxes and
school quality. Funding Local
Government Aid to create greater bal-
ance among city levies will not ensure
tax fairness if school funding is allowed
to be pushed onto the local districts.
In the special legislative ses-
sion, the coalition is supporting the
Senate education bill because it pro-
vides for a 5 percent formula increase
in school funding in the first year and a
4 percent increase in the second year of
the biennium. Moreover, the Senate
bill pays for the new funding without
raising school property taxes, shiftin.

House put valuable programs at risk in
the future.

Chisholm, carried our legislation that
would have provided $14 million for a
business infrastructure grants program
and $10 million for redevelopment
grants in greater Minnesota. In the
Senate, the funding was incorporated
into the bonding bill authored by Sen.
Keith Langseth, DFL-Glyndon.
Rep. Morrie Lanning, R-
Moorhead, and Sen. Tom Saxhaug,
DFL-Grand Rapids, offered coalition-
proposed legislation that would have
earmarked $20 million for matching
grants to cities facing new environ-
mental mandates. Both the House and
Senate bills received strong bi-partisan
support from greater Minnesota legisla-
tors.
The final bonding bill included
$10 million for outstate business infra-
structure grants, $8.4 million for
greater Minnesota redevelopment
grants, and $2 million for environmen-
tal mandate grants.
Langseth and Rep. Dan
Dorman, R-Albert Lea - chairs of the
Senate and House bonding committees
- supported funding for the coalition's
programs. As chairs of the two com-
mittees, they were instrumental in pro-
ducing a compromise bonding bill with
an urban-rural balance.

Highways Should Not be Sacrificed for Transit
A projected $1 billion trans-
portation shortfall in 2008 and this
year's $60 million shprtfall in funding
for metro transit left legislators scram-
bling this sessign for ways to meet
Minnesota's transportation needs.
The Coalition of Greater
Minnesota' Cities supported both a gas
tax increase and an amendment that
would have prevented the commission-
er of transportation' from changing the
formula for distributing federal high-
way funds.
The coalition opposed, howev-
er, the transportation bill that Gov. Tim
Pawlenty eventually vetoed. The bill
represented poor tax policy that would
have shortchanged roads and highways
throughout greater Minnesota.
Included in the bill was a plan
to designate a quarter percent of the
existing sales tax collected in the Twin
Cities metro area for transit. This dis-
proportionate, discriminatory taxing

structure would have required taxpay-
ers outside the metro area to pay a 6.5
percent sales tax for general fund pro-
grams, while taxpayers in the Twin
Cities would have paid only a 6.25 per-

revenues that are fairly allocated to
transportation needs throughout
Minnesota.

Moreover, the plan would
have created a $100 million hole in the
general fund. Money currently used for
highways would have been rerouted to
fill the general fund deficit. In addi-
tion, the transportation bill would have
given metro transit a windfall of $92
million more than its deficit at a time
when funding for greater Minnesota
roads is desperately needed.
The CGMC's position angered
many metro area legislators who are
transit advocates. Coalition lobbyists
regularly were pressured to drop their
opposition to the transportation bill.
The coalition, however, remains stead-
fast in its opposition to increasing state
funding for metro transit without rais-
ing the state's 20-cent gas tax.
Four years ago, the state of
Minnesota picked up 27 percent of the
operating costs for transit in the Twin
Cities. Today the state pays 64 percent
of the system's operational costs.
Nationally, Minnesota ranks second in
terms of its support of a regional mass
transit system for populations over one

No fields, wetlands nor woods would have to be disturbed.
With no N""EW roads, costs would be minimized.
Let's have a look. There will be 2 areas considered, one on S1. Joe's south and southwest
sides, the other on the north, northwest, and west sides.

SOUTH & SOlJTHWEST of St. Joseph (including a better way to St. Cloud):
The culprit? Roads that go nowhere, some to dead ends, some bending back upon
themselves or other existing roads, and especially, some in such condition that eyen those
wishing to use them better have another set of shock absorbers.

Albeit, S1. Joe is already growing - the south side targeted right now as a future traffic
problem. How do we get in and out, especi~lly with St. Cloud involved, without over
extending Minnesota St. and County Road 75 (CR 75)? And without destroying our
beautiful natural environment?
THE SOLUTION:
Utilize, and improve, already:EXISTING ROADS.
Which ones? Look at your map - in a west to east direction from the center of St. Joe to
S1. Cloud - here are the ones I'll refer to: College Ave., County Road 121 (CR 121).
County Road 138 (CR 138), 86th Ave., Bel Clare Dr., County Road 23 (CR 23), and
finally, County Road 137 (CR 137).
As the southern portions of St. Joe get developed, Make sure the developers give good
access to CR 121 & CR 138. This takes Minnesota 81. out ofthe picture. Forthose
wishing to utilize CR 75 eastbound, give them alight near Fleet Farm so they can take
their left and on up to CR 75.
Want to take CR 23 eastbound instead? Take 86th Ave. right after you join CR 138,
cross the railroad tracks onto Bel Clare Dr. and a left onto CR 23. These are the roads
that need great improvement (as does the rail crossing), but THEY EXIST. A light
would be needed at CR 23, especially for the next step.
Want to avoid CR 75 & CR 23 completely'? Continue across CR23 and take a left onto
CR 137 and into Waite' Park. This avoids the Crossroads area all together. CR 137 goes
past Quarry Park, becomes listed as 7th St. 8 in Waite Park, and finally as 22nd St. S in
S1. Cloud. This will become our connection to St. Cloudis east-west alternative when
they finally decide upon which street to utilize on their south side.
And donlt forget, the interchange of CR 23 with Interstate 94 will become the interchange'
of choice for:all these new south-side residents, not Minnesota St.

All 5,' particularly 3, 4, & 5. The wonderful n~tura1 beauty of our area will be preserved
and continued to be enjoyed. We will have growth without rape of the land ~ and all it
will take will be productive interaction with city, township, county & state people.
NORTH, NORTHWEST & WEST of St. Joseph:
the main reason for all problems in this traffic area is the lack of a full interchange
between County Road 75 (CR 75) and Interstate 94 (1-94).

Let's look at traffi_~ on County Road 2 (CR 2). Whether the traffic is southbound or
northbound, it has to use the full interchange ofCR 2 & 1-94 to Continue. This situation
puts it right into St. Joe and onto one portion or another of Minnesota St.
Compound that situation with traffic westbound on CR 75 wanting to continue south
(east) on 1-94. More traffic on Minnesota S1.
Add to that the southbound traffic of CR 2 wishing to continue south (east) onto 1-94.
:. More traffic dumped onto Minnesota St. Why didn't the CR 2 traffic use a route through
St. Cloud to get to 1-94? Like. they need more traffic - especially around Crossroads.
THE SOLUTION:
Reconstruct the 1-94 & CR 75 interchange to be a.full one (the ability to travel any
direction).
Then close CR 2 as we know it now going through St. Joe.
Reroute CR 2 over to County Route 3 (CR 3) and use the 1-94/CR75 interchange.

Or even better, find a way to get CR 2 over to the new interchange without even getting
on CR 3 or CR 75.
GOALS ACHlEVED:
