Pursuant to due call and notice thereof, the Planning Commission for the City of St. Joseph met
On Monday, October 11th, 2021 at 6:01 PM. in the St. Joseph City Hall opening with the Pledge of
Allegiance.
Planning Commission Members Present: Commissioners Mike Osterman, Chad Hausmann, Carmie Mick,
Mike Ross, Anne Jarrell, Bob Loso, Gina Dullinger
Staff Present: Nate Keller Community Development Director
Approval of the Agenda: Ross made a motion to approve the agenda. The motion was seconded by
Jarrell and passed unanimously by those present.
Approval of the Minutes: Loso made a motion to approve the minutes of September 13th, 2021. The
motion was seconded by Ross and passed unanimously by those present.
New Business:
a. Public Hearing, Preliminary Plat Rivers Bend 4
Community Development Director Nate Keller stated that there is a request for a preliminary and a final
plat for this project from the applicant CLC Partners. Existing zoning is R-4 and the property is located at
off of College Ave (CR 121) and NW of River’s Bend 2 and Lanigan Way SE. The access will be off
College Ave (CR 121). An access permit will be required from Stearns County. Formal engineering
comments are pending. The developer will need to provide additional storm sewer inlet/pipe, another fire
hydrant, higher street standard including deeper aggregate base, clarification on sub drainage,
adjustments to some of the lot grading. There are wetlands on this property and they are not proposed to
be disturbed.
Hausmann opened the public hearing for the Preliminary and Final Plat Approval.
Gary Nordmann, 9352 290th Street, St. Cloud, asked where the storm water would go. He also had
questions about beaver dams in the location.
The Commission pointed out that the diagram indicates there is a proposed storm water basin within this
piece of property on the east corner.
Keller verified that the storm water would be retained within the out lot through a storm water basin and
should funnel over the ditches or through the storm sewer collection system. There was discussion on if
the ditch was public or private. Potential issues with beaver dams are an issue at this location regardless
of the proposed development. The conclusion was that these concerns would be noted in the comments
to the engineer.
Resident, inquired if the intent of these proposed building was to be owner occupied residential or are the
planned to be rentals? She also asked about the price point for the units, the traffic in that area and the
wetlands.
Keller verified that any owner would have to obtain a rental license and that the intent for this
development is rentals.
Rick Poplinski (developer) stated that the development is planned to be high end rentals.
Keller added that the County owns the Right of Way at CR 121 and they are reviewing the project and
suggest any infrastructure changes. A sidewalk is planned to create a safe crossing. He also detailed
some of the requirements that the developer is responsible for in relation to the wetlands.

Commission verified that a silt fence if used, would be the responsibility of the home builder to remove.
The Commission explained the difference between what a developer and a home builder do and
responsibilities for each.
Tom Schuller, 320 Lanigan Way SE, spoke on concerns about traffic and what the future of Lanigan Way
SE looks like.
Keller explained Lanigan Way will eventually connect to the West across from Jade Rd. This will allow for
traffic to have two ways in and out of that area. This proposed development will not have any connections
made to Lanigan Way.
Resident who lives on Lanigan Way SE, spoke on the drainage concerns and existing traffic near the site
and by Kennedy.
Commission replied and discussed the safety of the area near Kennedy School. They recognize the
concerns. Keller stated that there is a plan to compile data and address the needs as they align with
growth potential. The Commission also reiterated that safety work in this area would be a collaboration
with the County. It was also verified that this area is zoned R4, which allows for up to six units an acre.
Hausmann closed the public hearing for the Preliminary and Final Plat Approval.
The Commission discussed the proposed drainage pond as it relates to the wetlands. It was verified that
the existing wetlands would not be modified. The Commission also expressed concerns that engineering
comments were not fully addressed yet. Keller explained that staff is reviewing the engineering with staff
and the applicant. There was some discussion on the timeline of the project.
Loso motioned to table the Preliminary and Final Plat Approval Request with the intent to call a
special meeting in two weeks, pending engineer full review comments. Staff will give the
appropriate notifications to the public; seconded by Dulllinger and passed unanimously.
d. e. f. Public Hearing, Preliminary Plat and Final Plat, St. Joseph City Center
Planning Commission recommended that disposal of the property is in conformance to the
Comprehensive Plan at Feb. 8th, 2021 meeting. The subject property is the Fire Hall/Village Hall Building.
The proposed plat will divide the property into two parcels. Administration is still working on the final
details for developer’s agreement. That will be presented to the Council should this be approved.
Hausmann opened the public hearing for the Preliminary and Final Plat Approval for the St.
Joseph City Center.

The Commission discussed future parking in the area prior to any motion.
Dullinger motioned to approve the Resolution for the Preliminary Plat for the St. Joseph City
Center; seconded by Loso and passed unanimously.
Dullinger motioned to approve the Resolution for the Final Plat for the St. Joseph City Center;
seconded by Loso and passed unanimously.

Other Business:
a. Home Occupation Discussion
Staff have received a few questions on the pupil requirements as it relates to home occupations involving
teaching. A couple specific inquiries were interested in allowing greater flexibility in the number of pupils..

The intent of a home occupation is to maintain the residential character of the neighborhood while
allowing uses that do not conflict with the character of the neighborhood.
The Commission discussed a number of potential scenarios in which a special home occupation licenses
would be issued. The consensus was that due to the variation in types of home occupations, hours of
operation and required parking, the impacts to neighborhoods could be vastly different. It was determined
that at this point, the home occupations be examined on a case by case basis with special conditions
being required if the Commission felt necessary.
Adjourn: Dullinger moved to adjourn the meeting at 7:30 PM. The motion was seconded by Loso
and the motion carried.

Mick motioned to approve the Preliminary Plat resolution for River’s Bend 4. The motion was
seconded by Osterman and passed unanimously.
c. Final Plat Rivers Bend 4
Loso made a motion to approve the Final Plat resolution for River’s Bend 4. The motion was
seconded by Dullinger and passed unanimously.
Adjourn: Dullinger moved to adjourn the meeting at 6:08 PM. The motion was seconded by Loso

STAFF RECOMMENDATION: Approve request for exceeding the maximum percentage for
architectural metal.
PREVIOUS PLANNING COMMISSION ACTION: When Bad Habit moved to the old City Hall
location the Planning Commission and Council approved the original remodel to exceed the allowed
architectural metal percentage (2017/2018)
BACKGROUND INFORMATION:

Future Land Use: Downtown Commercial

Access: No change in proposed accesses

WCA/Wetlands: N/A
Ordinance: Building materials within the B-1 downtown district must adhere to the
following requirements:
Subd. 7: Building Materials. Building facades shall be designed to avoid a monolithic design and feature
divisions in materials, textures and separate entrance treatments. The exterior surface of all buildings
and structures must be constructed of one of, or a combination of, the following building materials.
a) Brick or face brick including textured, burnished and colored block;
b) Specially designed precast concrete units if the surfaces have been integrally treated with
an applied decorative material or texture (excluding raw concrete block painted or
unpainted or ceramic faced);
c) Wood;
d) Natural or cut stone;
e) Glass or any combination thereof;
f) Stucco;
g) Pre-finished architectural metal panels when utilized for accent and/or architectural
components of buildings such as the entry or entry appendage, a required enclosure or

screen or architectural roofing as an intended designed accent (not to exceed 15% of the
exposed wall area on any two visible sides of the building).
Applicant is proposing the new addition to have walls that consist of 61% architectural
metal. The Commission must evaluate the request and provide a recommendation to City
Council.
h)Any other materials approved by the City Council after a review and recommendation by
the Planning Commission, including but not limited to durable decorative synthetic
material or concrete composite material found to be comparable or superior which
mimic the appearance of other approved materials.
i)Roof Materials. All roofs which are exposed to a view or are an integral part of a
Building’s aesthetics will be constructed only of commercial grade asphalt shingles,
wood shingles, standing seam metal, slate, tile or copper. The City Council may consider
green roof options that reduce stormwater runoff and improve water quality.

Dear Mr. Larsen and Mr. Wilson,
The City of St. Joseph has completed a review of your request for site plan approval for the development of an
expansion at Bad Habit Brewery addressed as 25 College Ave N St. Joseph, MN 56374. In reviewing the site
plan application, I offer the following review comments and corrections needed. Corrections shall be submitted
before site plan is approved.
Engineering Department: Comments are below:
•Roof drainage, scuppers, and the like, shall not discharge to the alley or the alley boulevard. The
alley pavement profile grade west of the existing catch basin in the center of the alley is irregular,
and contributing additional drainage to the pavement surface shall be avoided.
•Considering winter maintenance activity through the alley, considering selecting patio fence
materials that will be stout enough to withstand plowed snow coming into contact with the fence.
•Consider evaluating the condition of the existing vitrified clay pipe sanitary sewer service that
originates from the alley, and consider upgrading the pipe materials to PVC pipe, accordingly.
•Any emergency gate access from the patio on the southeast side shall be directed to the College
Avenue sidewalk, and not the alley.
Refuse Enclosure:
The plan shows a trash enclosure on site but no details are provided. The existing trash area is not enclosed and
does not meet the standards of the code.
Ordinance: 502.50 Subd. 8 C Waste Handling Screening. All waste and recycling areas must be either
stored in the principal building or stored in a four (4) sided enclosure at a minimum of five (5) feet in
height constructed of brick, stone, decorative concrete material or a material comparable and compatible
with the material of the principal building. Waste handling areas should be shared between lots and
buildings to the extent possible to minimize their impact and must be located on the rear of sides of
buildings to minimize visibility from roadways. Any changes to trash handling areas once a building is
constructed must comply with this Ordinance and requires approval by the City.
Corrections needed: Provide specs and details for the trash enclosure to ensure compliance with 502.50 Subd.
8 C

Ordinance: 502.50 Subd. 7 G does not allow more than 15% of the exterior building finish (exposed area) to be
constructed of pre-finished architectural metal. The plan appears to propose 61% architectural metal.
Corrections needed: A230 depicts architectural metal for the walls. Please verify the metal is pre finished
architectural metal in accordance to code requirements and is not another non-compliant metal.

Warehouse space of 2,647 SF (Code requires 1 space per 1,000 SF)
Event/bar space of 1,575 SF (Code requires 1 space per 100 SF)
Existing Space includes:
Warehouse space of 2,860 SF
Bar space of 1,175 SF
Total space = 5,507 SF (warehouse) and 2,750 SF (event/bar space)
Total spaces needed: Thirty-three. Five for warehouse and twenty-eight for bar/event space
The lot has forty-one spaces plus a potential six spaces could be added on the SW portion of the site. Parking
requirements have been met so no further action or corrections are needed.

We received your comments dated December 3, 2021 and we would like to address them individually below.

building will be directed to storm sewer and will tie into the catch basin in the alley.

Fence material selection will attempt to mitigate this.
·Consider evaluating the condition of the existing vitrified clay pipe sanitary sewer service that
originates from the alley, and consider upgrading the pipe materials to PVC pipe, accordingly. This
has been considered. We will review the pipe as excavation commences.
·Any emergency gate access from the patio on the southeast side shall be directed to the College
Avenue sidewalk, and not the alley. We will attempt to make this connection. Building code
may dictate that the emergency gate be in a different location.

The plan shows a trash enclosure on site but no details are provided. The existing trash area is not enclosed

5. THE CONTRACTOR SHALL BE RESPONSIBLE FOR PROVIDING AND MAINTAINING TRAFFIC
CONTROL DEVICES SUCH AS BARRICADES, WARNING SIGNS, DIRECTIONAL SIGNS, FLAGMEN
AND LIGHTS TO CONTROL THE MOVEMENT OF TRAFFIC WHERE NECESSARY. PLACEMENT
OF THESE DEVICES SHALL BE APPROVED BY THE ENGINEER PRIOR TO PLACEMENT. TRAFFIC
CONTROL DEVICES SHALL CONFORM TO APPROPRIATE MNDOT STANDARDS.
6. ALL SLOPES SHALL BE GRADED TO 4:1 OR FLATTER, UNLESS OTHERWISE INDICATED ON THIS
SHEET.
7. CONTRACTOR SHALL UNIFORMLY GRADE AREAS WITHIN LIMITS OF GRADING AND PROVIDE
A SMOOTH FINISHED SURFACE WITH UNIFORM SLOPES BETWEEN POINTS WHERE
ELEVATIONS ARE SHOWN OR BETWEEN SUCH POINTS AND EXISTING GRADES.
8. SPOT ELEVATIONS SHOWN INDICATE FINISHED PAVEMENT ELEVATIONS & GUTTER
FLOW LINE UNLESS OTHERWISE NOTED. PROPOSED CONTOURS ARE TO FINISHED
SURFACE GRADE.

10. CONTRACTOR SHALL DISPOSE OF ANY EXCESS SOIL MATERIAL THAT EXISTS AFTER THE SITE

THE NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM (NPDES) PERMIT
REQUIREMENTS.
12. PRIOR TO PLACEMENT OF ANY STRUCTURE OR PAVEMENT, A PROOF ROLL, AT MINIMUM,
WILL BE REQUIRED ON THE SUBGRADE. PROOF ROLLING SHALL BE ACCOMPLISHED BY
MAKING MINIMUM OF 2 COMPLETE PASSES WITH FULLY-LOADED TANDEM-AXLE DUMP
TRUCK, OR APPROVED EQUAL, IN EACH OF 2 PERPENDICULAR DIRECTIONS WHILE UNDER
SUPERVISION AND DIRECTION OF THE INDEPENDENT TESTING LABORATORY. AREAS OF
FAILURE SHALL BE EXCAVATED AND RE-COMPACTED AS SPECIFIED HEREIN.
13. EMBANKMENT MATERIAL PLACED BENEATH BUILDINGS AND STREET OR PARKING AREAS
SHALL BE COMPACTED IN ACCORDANCE WITH THE SPECIFIED DENSITY METHOD AS
OUTLINED IN MNDOT 2105.3F1 AND THE REQUIREMENTS OF THE GEOTECHNICAL
ENGINEER.
14. EMBANKMENT MATERIAL NOT PLACED IN THE BUILDING PAD, STREETS OR PARKING AREA,

GRADING LEGEND
1. LOCATIONS AND ELEVATIONS OF EXISTING TOPOGRAPHY AND UTILITIES AS SHOWN ON
THIS PLAN ARE APPROXIMATE. CONTRACTOR SHALL FIELD VERIFY SITE CONDITIONS AND
UTILITY LOCATIONS PRIOR TO EXCAVATION/CONSTRUCTION. THE ENGINEER SHALL BE

SEED. THESE AREAS SHALL BE WATERED UNTIL A HEALTHY STAND OF GRASS IS OBTAINED.
SEE LANDSCAPE PLAN FOR PLANTING AND TURF ESTABLISHMENT.
5. THE CONTRACTOR SHALL BE RESPONSIBLE FOR PROVIDING AND MAINTAINING TRAFFIC
CONTROL DEVICES SUCH AS BARRICADES, WARNING SIGNS, DIRECTIONAL SIGNS, FLAGMEN
AND LIGHTS TO CONTROL THE MOVEMENT OF TRAFFIC WHERE NECESSARY. PLACEMENT
OF THESE DEVICES SHALL BE APPROVED BY THE ENGINEER PRIOR TO PLACEMENT. TRAFFIC
CONTROL DEVICES SHALL CONFORM TO APPROPRIATE MNDOT STANDARDS.
6. ALL SLOPES SHALL BE GRADED TO 4:1 OR FLATTER, UNLESS OTHERWISE INDICATED ON THIS
SHEET.
7. CONTRACTOR SHALL UNIFORMLY GRADE AREAS WITHIN LIMITS OF GRADING AND PROVIDE
A SMOOTH FINISHED SURFACE WITH UNIFORM SLOPES BETWEEN POINTS WHERE
ELEVATIONS ARE SHOWN OR BETWEEN SUCH POINTS AND EXISTING GRADES.
8. SPOT ELEVATIONS SHOWN INDICATE FINISHED PAVEMENT ELEVATIONS & GUTTER
FLOW LINE UNLESS OTHERWISE NOTED. PROPOSED CONTOURS ARE TO FINISHED
SURFACE GRADE.
9. SEE SOILS REPORT FOR PAVEMENT THICKNESSES AND HOLD DOWNS.
10. CONTRACTOR SHALL DISPOSE OF ANY EXCESS SOIL MATERIAL THAT EXISTS AFTER THE SITE
GRADING AND UTILITY CONSTRUCTION IS COMPLETED. THE CONTRACTOR SHALL DISPOSE
OF ALL EXCESS SOIL MATERIAL IN A MANNER ACCEPTABLE TO THE OWNER AND THE

11. ALL CONSTRUCTION SHALL CONFORM TO LOCAL, STATE AND FEDERAL RULES INCLUDING
THE NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM (NPDES) PERMIT
REQUIREMENTS.
12. PRIOR TO PLACEMENT OF ANY STRUCTURE OR PAVEMENT, A PROOF ROLL, AT MINIMUM,
WILL BE REQUIRED ON THE SUBGRADE. PROOF ROLLING SHALL BE ACCOMPLISHED BY
MAKING MINIMUM OF 2 COMPLETE PASSES WITH FULLY-LOADED TANDEM-AXLE DUMP
TRUCK, OR APPROVED EQUAL, IN EACH OF 2 PERPENDICULAR DIRECTIONS WHILE UNDER
SUPERVISION AND DIRECTION OF THE INDEPENDENT TESTING LABORATORY. AREAS OF
FAILURE SHALL BE EXCAVATED AND RE-COMPACTED AS SPECIFIED HEREIN.
13. EMBANKMENT MATERIAL PLACED BENEATH BUILDINGS AND STREET OR PARKING AREAS
SHALL BE COMPACTED IN ACCORDANCE WITH THE SPECIFIED DENSITY METHOD AS
OUTLINED IN MNDOT 2105.3F1 AND THE REQUIREMENTS OF THE GEOTECHNICAL
ENGINEER.
14. EMBANKMENT MATERIAL NOT PLACED IN THE BUILDING PAD, STREETS OR PARKING AREA,
SHALL BE COMPACTED IN ACCORDANCE WITH REQUIREMENTS OF THE ORDINARY

7. A MINIMUM VERTICAL SEPARATION OF 18 INCHES IS REQUIRED AT ALL WATER LINE CROSSINGS
WITH STORM SEWER. THE WATER LINE SHALL NOT HAVE JOINTS OR CONNECTION WITHIN
10-FEET OF THE CROSSING. INSULATE CROSSINGS WITH STORM SEWER.
8. STORM SEWER PIPE:
A. PVC STORM SEWER PIPE AND FITTINGS SHALL BE PER ASTM D3034 (SDR 26 AND 35) OR
ASTM F794 (SCH 40). PVC PIPE SHALL BE INSTALLED PER ASTM D2321.
B. ALL STORM SEWER JOINTS AND STRUCTURE CONNECTIONS SHALL BE GASTIGHT OR
WATERTIGHT AS REQUIRED BY MINNESOTA PLUMBING CODE, PART 707.3. STORM SEWER
SHALL BE TESTED PER MINNESOTA PLUMBING CODE, SECTION 712, EXCEPT AS PROVIDED IN
SECTION 1107.
9. ALL NONCONDUCTIVE PIPE SHALL BE INSTALLED WITH A LOCATE (TRACER) WIRE PER
MINNESOTA PLUMBING CODE, PART 604.9.
10. AFTER CONSTRUCTION IS COMPLETED, THE CONTRACTOR SHALL PROVIDE THE OWNER WITH
AN AS-BUILT RECORD OF UTILITY CONSTRUCTION. THE AS-BUILT SHALL INCLUDE LOCATION
AND LENGTH DEVIATIONS OR CHANGES TO THE PLAN. CONTRACTOR TO VERIFY WITH OWNER
OR ENGINEER WHETHER A PLAN WITH POST-CONSTRUCTION ELEVATIONS IS REQUIRED.

BACKGROUND INFORMATION:
5b – attached is the proposed meeting schedule for 2022. No changes on the proposed time and day of
month from 2021. All meetings will occur on the 2nd Monday at 6PM.
5c – staff is looking for nominations for 2022 Chair and Vice Chair.
5d – Staff will provide a brief verbal update pertaining to best practices for calling a Special meeting
