ACTION REQUESTED Discussion and Direction. REFERENCE AND BACKGROUND Joel Vogel resides at 212 16th Ave. SE and has a private driveway access on Baker Street. Mr. Vogel has reportedly experienced drainage issues near his rear garage which is accessed via the Baker Street driveway. There is a stormwater drain basin and inlet located near the end of his driveway in the City right of way. Mr. Vogel has made requests to Council Members and staff that the inlet be lowered to allow for improved drainage. The City Engineer and Public Works Superintendent will be present to answer questions the Council may have and to speak on the drainage issues in the area. It does not appear that merely lowering the inlet will solve the problem. The property behind Mr. Vogel’s residence would likely need to be regraded to allow for positive drainage to the inlet. The City is generally not financially responsible to grade private property to ensure proper drainage. BUDGET IMPACT Unknown at this time. STAFF RECOMMENDED ACTION To be determined. REFERENCE AND BACKGROUND The next step in the process is to determine the City’s Vision and Strategic Plan. Each section typically takes a half day and can be done on the same day if desired. Some ideas for projects are listed below. Grant Ideas Project One - Trail along College Ave/CR 121 connecting to East Park Issue: current trail along College/CR 121 ends at Jade Road. Trail should be extended to East Park. Grant source: Transportation Alternatives Program Match: 80% federal and 20% state/local match. Timeline: • Monday October 2, 2023 – Announce TA solicitation. Open letter of intent period. • Friday, November 3rd, 2023 – Deadline for applicants to submit letters of intent. • Monday, November 20th, 2023 – Deadline for RDO/MPO/district review of letters of intent. Recommendation to proceed forward with full application given to applicants. • Friday, November 24th, 2023 – Official start of full application period. • Friday, January 12th, 2024– Deadline for applicants to submit full applications. • Friday, April 12th, 2024 – Deadline for ATPs to select TA projects. Note: Funding will not be provided until 2028 if grant app is successful. Applicants can elect to do advanced construction but will not be reimbursed until 2028. Project Two: Business Development Public Infrastructure Grant – Industrial Park Phase 2 Issue: Industrial park lot availability is dwindling. Over half of all the lots in the Northland Business (off County Road 133) have been purchased, or under Purchase Agreement. Remaining lots are small (narrow) and not conducive to larger users. Match: 50% state and 50% local Timeline: Applications are first come first serve. Note: Further discussions with property owner and platting needs to occur. Staff will have to pull together cost estimates based on a ghost plat/layout. Potential Zoning hurdles depending on what land is included for Expansion (amendment to Future Land Use map). Potential Project – Local Housing Aid for Greater MN Cities Issue: We have a small amount of vacant single-family lots available (less than 25 with over 20 in Northland Height area). Many of the next areas for single-family growth require significant lift station investments. Match/Timeline/Notes: Much is still not clear on program specifics. Webinar will be held on 08/30 where more information will be shared. May not have a viable project depending on program criteria. Others??? BUDGET IMPACT Will depend on grant costs, project scope, and match requirements. Cost information and project specifics would be brought forward once a priority project is identified. ACTION REQUESTED Discussion and Direction. REFERENCE AND BACKGROUND The lobbying contract with Chris DeLeforest has expired. Staff will need direction on moving forward with a new contract for lobbying services to help ensure securing Federal Funding for the CR 2 Sewer Extension Project. Flaherty & Hood also provides lobbying services and can be considered as well. BUDGET IMPACT Unknown at this time. STAFF RECOMMENDED ACTION None at this time. DeLaForest, CEO CONSULTANT SERVICES AGREEMENT THIS AGREEMENT is by and between DeLaForest Consulting, LLC, 855 Village Center Drive #340, Saint Paul, MN 55127 (referred to hereafter as "Consultant") and the City of Saint Joseph, 75 Callaway Street East, Saint Joseph, MN 56374 (referred to hereafter as "Client"). RECITALS WHEREAS, the Client wishes to purchase professional legislative and lobbying services to assist in promoting its interests; and, WHEREAS, Consultant has represented that it has the experience, knowledge, and contacts to effectively provide professional legislative and lobbying services and is able to provide such services. NOW, THEREFORE, for good and valuable consideration, the parties to this Agreement make the following promises and covenants: AGREEMENT Services to be Provided. Consultant shall furnish to Client, in accordance with the terms of this Agreement, provide professional lobbying and legislative services before the Minnesota Legislature in furtherance of the Client's interests during the 2023 legislative session. 1. Consultant shall devote the time necessary to provide quality, professional lobbying services in support of these client legislative objectives: a. A local option sales tax for the city; b. A specific sales tax exemption for materials and supplies used in the construction or rehabilitation of identified city capital projects; c. A general sales tax exemption for materials and supplies used by all Minnesota local governmental units used in the construction or rehabilitation of capital assets; d. Securing bonding dollars for the city's own sewer main improvements, wastewater collection system and related infrastructure; e. Secure additional bonding appropriations for the city community center as well as protect current appropriations from cancellation. 2. Compensation to Consultant. In consideration of the services to be performed by Consultant pursuant to this Agreement, Client agrees to make payment to Consultant in the amount of Sixteen -Thousand ($16,000) dollars total, which shah be payable upon invoice in $4,000 installments, upon the presentation of an invoice, each month of the contract term. 3. Required Filings. Reports. Consultant shall prepare and timely file all required filings and reports with the Minnesota Campaign Finance -and Public Disclosure Board and any other filings or reports required by law. 4. Rescission. Either party may rescind the Agreement upon a 15-day written notice to the other party. Consultant shall be paid, pro-rata, for all work completed through the date the rescission notice was received. 5. Confidentiality. Consultant agrees that all information provided to Consultant by Client other than information which is publicly available or expressly designated by Client as non - confidential, is confidential and proprietary to Client. Consultant agrees not to use any such confidential information other than as necessary to render the services under this Agreement and shall not disclose such confidential information to any third party during the term of this Agreement and thereafter. 6. Term. Notwithstanding the date of signatures of the parties to this Agreement, the term of this Agreement shall be from February 6, 2023 to June 6, 2023. 7. Amendment. This Agreement may be amended by mutual, written agreement of the parties. 8. Complete Agreement. This Agreement memorializes the complete agreement between the parties. Any -other -promisese declarations, -or representations, -whether oral -or written,-a-re-nuil and void. 9. Sub -Contracting. The Consultant, at its sole discretion and expense, may retain other lobbyists or professionals under a sub -contract to assist in delivering services to the Client. JOSEPH SEWER MAIN PROJECT A $6 million request for State Funding to build a sewer main to serve as a catalyst to expand industrial/business development & workforce housing. This has been a community priority for many years. In 2006, the City invested by extending the water main and building a water treatment to serve the area. This investment would more than double the City’s development area from 2,000 acres to about 4,100 acres. Need to increase & diversify tax base. Approximately, 28% of property in St. Joseph is tax exempt due to being home to the College of St. Benedict. Access to major corridors, including Highway 75 & Interstate 94 connecting it to the region & beyond attracts industry. The City of St. Joseph Sewer Main Improvements will help to increase economic development, increase tax base and meet the demands of workforce needs as part of the St. Cloud Region.
